Go to your county clerk's office where you file for the divorce and tell them you can not locate your spouse. They will ask you at the county clerk office to pay for a police constable to track and deliver the divorce petition to her/him. If they police locates her then she gets the petition. If the police can not locate her/him, then they will send their report to the court and the Judge will sign your divorce and you will be free. Thats how its done here in Dallas. I hope that helps

Please i need one i have not had any since i came in this country

You request any health insurance that applies to you, most of them depends on your income guidelines. Check with your State Health Department or Agent.

Just adding here If the person works after filing VAWA without EAD the exemption does not apply.

I am confused that I can send FD-258  on my own i.e. take the finger prints and fill the form or I need to go somwhere such as police station or any third party to get this thing done. 

Don’t submit the FD-258,it will take long time to receive the FBI clearance  .You just need a simple police clearance of all counties that you lived in the past 3 years .

Marriage annulment is not common and is also very hard to proof, and you must fight it to the end to get a divorce and NOT an annulment.... marriage annulment is like a marriage is null, void,  never existed and for Vawa you must proof you were married and lived at some point with your abuser.. In Vawa USCIS may accept an marriage annulment case if  marriage was not legitimate solely because of the bigamy (married to someone else before marrying you and your were not aware of) and he was abusive.

FIGHT for a divorce and not an Annulment,..

 

Reason for a judge to grant  a marriage Annulment: 

You are close blood relatives, or close relatives by marriage or adoption (first cousins, siblings)

You were impotent and the marriage was not consummated.

You were still legally married to another person when the marriage took place

You were not legally old enough to be married at the time

You were forced into the marriage

You were not mentally competent when you entered into the marriage

Your marriage was fraudulent (green card fraud, criminal history, sexually transmitted diseases or impotence) **** which this is the one your abuser wants to file for***

Hello Sandra and everyone,  I don't understand very well. My EAD expired last year before filling VAWA. I sent my package in October 2018 with EAD renewal, I've applied for a job before EAD expired last year and I started working on Tuesday last week. It's advisable to continue working or not ? Pls I need help.
