Hello Bryan, I am on my 4th PF which is for 6 months each. I requested for all. They will renew it in a few days. If you don't have SSN or EAD It will help you to get a DL or some public benefits like health and financial aid. 

my case is an 18 months old but I think it is moving now because I get a biometrics and RFE last month.

But if you filed EAD c9 category from your 1485 petition you will get the EAD however from your post..you said your spouse withdrew it..so you may be getting c31 category when your vawa is adjudicated! I believe right now USCIS is processing October-November time frame.

Are you waiting for Vawa Approval? 

Count aprox 17-19 months to get approval IF you pass that time, make infopass to request info about the delayed or contact congressman local office.

If my math is right you should be getting an approval or RFE soon!

The category chosen on your EAD was C31 you will only get the EAD after your VAWA is approve (18-24 months), You should sent another I-765 form with C09 category along with a copy of your I-485 and I 360 receipt, to Vermont, but the wait time start again you might get it 3-6 months after you sent the new I-765 with the correct category.

Hello everyone 

i have a weird situation and then my naivety on this matter doesn’t help much either . I am married to a US citizen ( abuser husband ) we filed for I-130 /I-485/I-765 dec 2018. I haven’t still got my EAD - infact I got a RFE on I-360 last month asking to provide proof of bonafide marriage , but still no EAD .

i am still collecting paperwork’s for vawa 

my question is if I file vawa I-360 by July 2019 - when will I get a EAD based on this I-360 ? 

Whats a C9 and C31 and their timelines

C9 category EAD is the one you get for a pending I485. You can get that anywhere from 3 through 5months..( from experience) the c31 category is the one from an approved i360. Vawa is currently taking anywhere from 16 through 24months to reach a decision! So you get the c31 EAD when your Vawa Petition is approved! I hope your abuser didn't withdraw the i485..you should have gotten the c9 category or will be getting it any time now! I hope this helps!

So far as per my knowledge-my abuser hasn’t withdrawn the petition ... at least I haven’t been informed of so through my lawyer or USCIS so far . 

But the legal aid at the shelter said to me that even if vawa is filed concurrently with a new 485 - I still would receive a EAD based on vawa in 3/5 months - since I was married to a uSC - now I am confused as to will the EAD come after vawa is approved or in 3/5 months ..

sorry this is so confusing

It shouldn't be confusing..the c9 you're expecting based on i485 should have come already..but obviously it's taking time and should be here anytime now!  But you can help things along by contacting your representative! For the c31 category, it's usually sent after your vawa has been approved! It's that clear!😊

I apologize in advance- I am probably not able to understand you and it’s my fault . 

So any person filing VAWA is C31 automatically? 

And any person filing VAWA and hoping to get EAD under a VAWA petition always has to wait for EAD until VAWA is approved ( 16-24 months ) ?

LOL no worries I totally understand your confusion but you're right! Your statements are correct you probably find it hard to believe but yes that's the way it is!  EAD under vawa is in the c31 category! And yes it is issued upon approval of the petition! I have no problems if you still don't get..I can explain over and over..and just maybe before you fall asleep..you'll get it!😀😀

I haven’t got my EAD yet and if petitioner withdraws the petition then the C9 EAD becomes null and void and the 485 becomes void and denied as well since he withdrew the petition .

In that case If I file vawa and a NEW concurrent 485 will I still be able to get EAD in 3/5 months ? Even though petitioner has withdrawn the C9 EAD petition and now I have filed a NEW 485 and a VAWA ? 

will I still be able to get EAD in 3/5 months based on this new 485 and vawa ?

forget the processing time. They are working on October and November files. by now they might start on December.

My EAD has expired too,and i applied for it in march 2019,not sure how long that takes and should i be worried if i dont have my EAD by the time i get an approval notice (god-willing) or RFE from them ?
