Everyone's experience is so different! I wentΒ to my marriage-based interview in NYC to inform the officer I filed for vawa, and I didn't even talk to the officer. The receptionist took my docs and gave it to the officer and he said he doesn't need to talk to me because he has my documents already.

We also inform the receptionist butΒ the officer decided to see us anyways.Β I think all depends on the officer how they handled every case. I was surprise theΒ some officer and the superviser on the date knew my lawyer, she told me as an immigration lawyer you build a reputation on USCIS, she told me this month of MayΒ she has been there 5x already. That gave me confident. The officer also told my lawyer everything have to be sent to VERMONT for now on... (since she made the mistake on sending my EAD renewal to NBC)Β

Daniela if you husband is an LPR, did you submit the I-485 when a number was available for your ?because LPR spouses MUST NOT FILE FOR AOS if a visa number was not current.I am justΒ tryingΒ to understand about yourΒ interview..

so he gave me my copy of their response, whenΒ I was going through I noticed the initial category was C31 but he filed C09, I went back to him with the hope he made a mistake, then he brought out my file and showed me, the first time he filed for my i130 with category C31, vawa approves my EAD with C09 on the document, so when he filed for renewal he used C31 since that was what he initially used then it’s was returned and he now send in C09 which seems to be the correct one, andΒ we haven’t heard back since then.

USCIS made a mistake when they issued your EAD category C9 when you applied for category C31,and your attorney continued the USCIS mistake filing category C31 again.

Yes I had to wait for my priority date to become Current to file I-485 this is my timeline...

I-130 filed by husband on DEC. 2015

I-130 Approved April 2016.

I-485 Filed October 2017 (Priority date became Current) I also File I-485A (I am a beneficiary of the 245i Law) No need to depart from USA.

I-360 filed on June 2018.

I-485 Interview May 22, 2019 (On hold, to be transfer to Vermont)

waiting on I-360 approval.Β

I had 3 cases last year that the officer decided to go ahead with the interview.It's not a good or bad sign because you need to wait for the VAWA decision.

You are right dear it happens like this sometimes! When I went with my attorney I saw the familiarity between her and the USCIS officials..this is because she's a regularΒ to the block! LOL but thank God the purpose is achieved..it doesn't matter if they saw you or not! Goodluck with the rest of the journey!

Of course vawa has to be decided..but we were pointing out the fact that it saves time that would have gone towards waiting for i485 to be scheduled and adjudicated following approval of 1360!..looks like a good deal.😊
