@sandranj good morning!

sorry to bother you again but can you take a look at this and let me know if that’s what I need to send?

To recap, my husband withdrew his petition so I filled a new I-485 along with vawa.

Thank you!

He filed category C9. USCIS does not change the  category the person applied at all.

Hi Sandra,

I double checked now and here are the screenshots from receipt notice and eligibility category listed on i-765 filed by my attorney along with the VAWA petition. Anything to worry about?

It seems the IO didn't pay attention in the category filed,  you are lucky.

Hi everybody!

I just started to prepare my VAWA package. I will file on my own due to lack of money to pay for an attorney. I wanna ask some of you to please review my list and tell me if you think is enough or not.

-To proof abuse

*Affidavit from me

*Affidavits from people who saw or knew about the abuse

*Threatening communications (voice notes, emails) from spouse

*Report from therapy sessions

*Psyquiatric evaluation

-To prove that we lived together and bonafide marriage

*Bank account statements

*Tax return filed jointly

* Lots of pieces of mail to the same address

*One added to the other's health insurance policy

-Good moral character

*Police clearance showing no arrests, charges etc.

Plus the other forms.

Also I have a pending I-485 filed by my spouse. As of today he has not withdrawn it. However I don't want to sit around and wait for him to do it. Can I send a new I-485 with my VAWA package and request a new work permit? What will happen to the work permit I have now if I request for the other one? Can you have two at the same time?

One last thing, thank you to everyone who shares their stories here! It's good to know one is not alone when facing not only the trauma of experiencing violence in the hands of your spouse, but also the aftermath.

Good luck to everybody.

Do not send a new I-485 if your I-485 is still pending.

Hi, is removal of conditions on the green card based on extreme cruelty equivalent to VAWA?

If it is, I can share my experience after my interview this week on how the interview was, what questions were asked, what documents were presented and what was the final word.

I have read a lot of the posts here and I want to thank everyone for their contribution irrespective of the results I get this week. Keep sharing for the pain can only be reduced in a company full of understanding people.

Regards.

In my understanding No... If you are a victim of extreme cruelty and you already have your Conditional Green Card, you probably Submit I-751 with a domestic Violence waiver.... When you file this Form you need to also sent all the proof of Extreme Cruelty abuse you suffered along with Proof that you entered your marriage in good faith, this is why you are having an interview, you must also take all the proof to that interview to support your claim of the abuse and bonafide and maintain your Residency Status (green card) .. Difference from VAWA most applicants don't have a green card yet we sent all the abuse  proof to Vermont to be evaluated and finally approve by them, and than we apply for Adjustment of Status to obtain Green Card...

Please Yes share your experience on your Removal Conditional GC, interview base on Extreme Cruelty....

Ok got it! Thanks for the explanation, I somehow thought these are identical. I will share my N400 interview experience later this week. I got my green card last year with the waiver approved without an interview. I talked to a lawyer about the interview on that and I still feel maybe they didn't even look at my file somehow because my spouse had contacted DHS, USCIS and what not to get me deported and I was totally expecting an interview, however, lawyer told me that they must have looked at the file but didn't require an interview based on evidence submitted.

Anyways, will update you all what happens in the N400 interview because I had a tough time finding anyone describing their interview experience related to this (citizenship interview on the basis of green card obtained after extreme cruelty waiver approval).
