Am still married to my US citizen wife but we are not living together. She’s been very abusive and if I file a restraining order against her, will she be aware that I filed a restraining order because am about to file for vawa. Will the court let her know cause am scared of what she might do. She has our house keys and am always at work and am scared of her slipping into my house and maybe taking some documents from my house

Hi everyone

I applied for VAWA August 2018 but I never sent my psychological evaluation with my original package. I am now in process of obtaining one and I already have a letter from non profit domestic violence organization. 

My question is - should I wait for them to issue RFE for it or should I just mail it to them without waiting for RFE

Hi from what I've read on here, and research elsewhere..I think you are encouraged to send in any evidence that can help your case before a decision is reached using the blue slip..or so..that came with the Vawa receipt. Either you do that or wait..but if you do it...chances are that you may save time any additional evidence RFE might steal from you..only if that's the only thing missing! By all means get other opinions..this is just mines!😊

My understanding is if you file a restraining order against someone..they would be notified not to come within specified distance from you..I'm not an attorney but it's common sense..also you should have changed the locks to your place if you have fears of your spouse slipping in when you're away! Do please ensure your safety or peace of mind by securing your residence..if you feel you have to move to an unknown place to feel safe you are encouraged to. Hopefully you get other suggestions and opinions! Cheers.

Last time entry and divorce certificate . Regular few questions. Later today evening i got the message says “your card being produced we will mail to your address “. I am so happy finally. Like just said my interview will be in 10 days and just moved last month in my new Apartment i only changed my address online to the LOCAL OFFICE that received my I485.

Do i need to change my address to Vermont too?

For me I only changed my address online with NBC for my i485, I've never changed with Vermont for i360 but was made to understand on here that i360 should be changed only with a written notarized letter to Vermont and going for infopass to ensure it was done!😏 in your present circumstance, I am not sure you have any more dealings with Vermont..but that's just my opinion..you'll still find folks who'll dispute..and say you need to change with Vermont! So just do both! It's a win win in the end..it doesn't hurt..to be on the safe side!😉

The court have to notify your wife you have a restraining order against her, and she cannot violate, some court will set a court date for both of you guys to show up, to see if the restraining order will be temporary or final for a year or more, (That was my case). Only person who knows about your VAWA is you, your attorney and USCIS no one else, unless you choose to disclose it.

Change the locks of your house (if her name is not on the lease) if her name is on your house lease, than the restraining order should specify the address of your house and the stay away specification.

Secure all your documents even if the means taking it to your place of work if necessary, you need as many prove you can gather.  But if your wife violates the restraining order and go to your house, work etc. any place put on the order call the police and she will be arrested.
