No issue having the previous spouse based AOS closed. Honestly I understand why you are worried but really try to relax as you wait. The online system is a courtesy USCIS provides and should not be considered binding. The online system actually has a disclaimer stating such. From my observations- its a computer system that generates things based on its programming. Many times people get odd messages because the Officer does something that causes the system to generate a message. You will drive yourself crazy trying to figure out the internal workings of USCIS! I suspect if you had a previous 485 administratively closed it might have something to do with the weird update you got about case being transferred. USCIS is all about paperwork. Or again it could be like I said, something the Officer did during your approval process caused that message to generate. Keep checking the online system and Im sure any day now it will show card mailed. Hang in there!

Im sorry you had a bad experience. The good news is when you file for VAWA your case is evaluated by specially trained adjudicators in VSC.You should not have even attempted to explain your case to that Officer. The Officer CAN hold the AOS or they can deny it. Apparently she is going to deny the AOS you filed with your spouse.  And thats fine. USCIS is under no obligation to hold it for you, its just they can if they want. She can also forward you to removal proceedings or just let it sit as a denial/closed with no action taken. Hopefully you dont get sent to removal because that makes the VAWA process have more steps to deal with the removal issue. You need to file a new 485 and work permit if you need one as your old one is no longer valid (if you had one based on that AOS ).

Contact your local clerk to find out how to file divorce. In person or use their website. You do not need to speak with (meaning physically speak or see)  your spouse during a divorce outside of the court but there is correspondence- The correspondence will be all written and done between attnys (if you have them). The court clerk is your best resource. If you need private help navigating or questions about divorce issues/paperwork you can send me a message as divorce issues dont really belong in the VAWA thread. You can also make a thread in other sections of VJ where perhaps people in your location can offer advice or help on the paperwork. (I am in NC )

Im not really sure what you mean. You use the phrase 'out of processing times' and 'more time then estimated' as if they are two different things? Who gave you an estimate? If you have something from USCIS saying an estimated time and there was no response or action from them then a congressperson will probably help you. Generally congresspeople pre-scan people before agreeing to help and they will want it to be 'out of processing time' before they ask- since asking before that is pointless. Or if you have a separate issue that has nothing to do with general processing times, like a notice from USCIS saying expect to hear something in X days and you dont. Can you please expand on why you want to contact the congressperson?

Without the I-797 she cannot justify to her supervisor to hold the I-485.  She has no choice but to deny it.  If they issue the NOA1 befoe she denies it, she can put it on hold.

First I would like to say thank you for feeling other people situations and understating them situation . 

Thank you for clarification this matter  helping and understand where my worries is coming from .

The problem is the whole situation is scary and not easy at all from begging until the end .

Might what I am going to say now will makes some people worries more but please that's not the point .

The point is we have to be aware and know information about our situations.

 

I see some people they put them under removal even after getting GC which is very scary situation just for having 485 pending in the past from marriage case denied or other cases and the reason for putting them under removal is sometimes USCIS didn't having all information in them system and putting green card holder under removal just for pervious 485 denied in the past for any reason , I was shacked in heard this news from people .

What I am try to say is we have to know more information to avoid problems in the future too .

Xoxo, we all understand you but to be honest with you, you are overly worried, and is not good for your mental health. I am not saying that you don’t have to educate yourself, but you need to be more self-aware about your thoughts. Don’t think about your case being denied or close or whatever. Deal with things as they come. Be positive and be  mindful of all your negative thoughts. The mind can destroy you if you don’t know how to control it. You went to the interview you did your best. There is nothing else for you to do than wait. Put everything on your god’s hand. 🙏

@username_taken my choice of wording was poor. My apologies. I basically meant the same thing as to when congress can step in to inquire about a VAWA case.

No, I didn’t receive any letter or so from USCIS.

You really have to stop listening to rumors from others.  I have to tell people all the time to stop telling false tales and using scare tactics.

Good morning everyone I just wanted to share with you that my EAD card is being produced and I hope it will arrive in the next couple of days. Finaly a good news and one last thing I have to worry. 

 

Filed for the renewal of my EAD timeline 

 

filed for a EAD August of 2018

Transferred to a nother office in November 2018

The card is being produced  March 2019
