You're right if AOS(i485) is denied the c9 category becomes void. If it takes 30days for a good evaluation as suggested by your psychologist, then it's worth it. The dangers of submitting an incomplete petition is you get served RFE if the officer is kind enough or outright denial if the officer is not considerate! Thread carefully.

Good afternoon guys, 

 

I am desperate for any help or feedback for my current situation...

I'm an August 2017 filer. USCIS sent an RFE on Jan 26, 2019 that "could not be delivered by USPS" I sent the letter requesting USCIS to send it again and I also contacted my congress woman in Feb without an answer. 

Now I received it today only to find out this RFE expired April 26 😱Can somebody tell me what to in this case? This is a good moral character RFE and they want a letter from the country I resided in so it will take me at least 1 week to gather all police clearance letters from the countries and states I've lived in. 

 

Thanks for reading, any help would enormously appreciated. 🙏

I think you should explain to the Uscis and tell them ..they will understand...write them in time

I just wanted you all know that if I don’t answer all the posts is due that I don’t have an answer for whatever you are asking. 

I feel the pain and sorrow that we all are going through but I know deep inside we all going to succeed whatever life takes us.

Hi so sorry for this...are you using the services of an attorney? They should be able to notify USCIS of the fact that you didn't get the RFE in good time..from what you have said it is expired..if nothing is done it will be perceived by USCIS as being ignored and might lead to a denial! It's such a simple RFE but rather unfortunate circumstance...please table this before @sandranj hopefully she should be able to give you legal advice as prompt action needs to be taken from your end! Wishing you favourable intervention🙏

If she cannot help you she can definitely recommend a fellow colleague who probably is closer to your location. I live in NYC but cannot recommend my attorney to you because of the rather unprofessional experience I had with them. Hang in there you will get suggestions pretty soon. I think I saw a post that I can write a letter asking them not to send the NTA, does anyone know about this? 

I’ve meet with an attorney but she charges $12K and there is no way I can afford that. The probono from the catholic place had no idea about vawa and was googling it while I was talking to her so I’ll just do it myself.

Hello.. sorry to hear this abt ur marriage... well in my case my I had to send my vawa package first just to secure a spot , cos my psychology Evaluation took abt 2months to get ready, and I had to quickly send my vawa in before phychology Evaluationwas ready.. I got RFE to prove bonified marriage after 1month of filing vawa so when I was responding to the RFE my psychology Evaluation was ready then and so I added it to the REF and sent it and after 1month I got a prima facie...As long as you have proves for....

(1)bonified marriage.

(2)proves of the Abuse..

(3) Good moral character.. 

You are good to go... 

You need your vawa receipt as soon as you can becos ur ex has withdrawn ur i485... you need file form i360 vawa and New form i485 and form  i765 since u married to a US citizen
