SAVECaseCheck is a website that shows you when outside agencies have made an enquiry about your immigration status. It is nothing more than that. If you are out of status thats all the results would come up with.

But apparently it worked for him and he's also residing in Colorado... We're not living far from from each other. Different DMV though, I guess. I can only go and ask about it, no? I have all the time of the world right now... They also never said anything about the EAD. So maybe they are also a bit unknowing...

He didnt say if he was applying for an original temporary licence, had a temporary licence and was applying for a renewal temporary license or for a full license though... or whether he was in status still and was successful only because DHS confirmed he was in status still rather than the DMV going by the immigration documents he provided.

 

Of course, not all DMV agents know how to process immigrant DLs but even ones that do wouldnt be able to do much if they cannot offer you a DL because you are out if status. Even if they do run a check for your immigration status with DHS, it's still going to come back as out of status and if your state does not offer licenses to those out of status (which sounds exactly like your case) double checking your status is not going to make you be in status again.

@Eve81 I had a bit of a similar experience, however, I'm in Texas. I applied for a learner's licence which I then took the test and got it upgraded to a non-restricted licence but it is a temporary licence that is only valid for a year. Each time though they searched me 3 times - so they actually sent off a request manually to the DHS to verify my lawful presence and then I waited for that letter to come through and then was able to get my licence. Doing a little research on the Colorado DMV site, https://www.colorado.gov/pacific/sites/default/files/DR2300B.pdf seems they accept these forms of ID for those who cannot verify lawful presence through their I-94, but probably best to go in with it and see what they can do for you and or to see if you can get your partner to get half a day off or a day off on the day for your biometrics appointment.

Rules have changed since I came but yes CO does require EAD.

 

As an aside CO does have a License for Illegals and never looked at how it works but could well be an option.

As to the OP, yes, this is very common in most states.  When my fiancé came over on a K1, we went right down and got a learner's permit soon after marriage which was good for about 75 days.  Then when her GC came she took her road test and got her full DL.  One thing I was wondering was if they would issue the four year DL or just do a two year DL since she had a conditional GC, she got the four year version which makes sense as even with a two year GC, you do not go out-of-status when it expires as long as the ROC is filed.

A SAVE check would only verify federal legal status. Each state has their own rules on who qualifies for a driver's license or state ID. SAVE might work in a document-based issue, not in one where the individual does not meet the requirements for the state.

True. I would just also add that if one commits certain other offenses while also not having a valid license, that can become an aggravated felony, which does have immigration consequences.

Joking aside (:P), I believe one has to show evidence of residency for x months to qualify still.

So in NJ, My wife had an expired I-94 and was able to get the driving license based on the NOA1 (I-797) for Adjustment of Status (I-485). Later when the green card arrived we were able to extend the driving license, no need to wait for it to get the initial license though. 

 

As I mentioned in my thread, the answers from the DMV (Motor vehicle commission) were different depending on what office I went in to and also when I called them it was different depending on the person who answered. I recommend you try a different location within your state.

DMV site will say what is needed, DMV staff do have a reputation to live up to with giving out correct information.

 

I believe CA is like CO where you need EAD.

Seems they would verify you in SAVE, but if they cannot (i.e. it expired) you can still apply through making a special appointment as it states on the bottom.
