Does his bank statements show regular direct deposits of a work salary?  If so, I would not worry about it, many folks do not get pay stubs anymore.

Hes actually been off work for 8 weeks looking after his father, but he has been depositing money.  Im worried him being off will be a problem

With London, that is typically satisfactory for the CO. For most other embassies and consulates, I would say you need the paycheck or else risk a 221g.

 

Note that he will need / should provide pay stubs when he completes an I-864 for AOS after marriage in the US.

"Off work" meaning...? Paid time off? FMLA leave? Or is he technically unemployed?

we never submitted any paystubs or employers letter during k1 visa process/interview..we only submit a paystubs and employers letter during aos and we get through to it fine...W2 and bank account is one of our strong affidavit of support evidence and my husband bank account that time has not much money in it lol.its just his w2 showed how much salary he has.

 

depends to every case though

Hes still employed but he has been upaid, hes a contractor so he files his a 1099 also.  He is due to start back any day now

Gotcha. Then he has no paystubs - he's self-employed. The tax return shows his current income.

Hi! We are currently waiting for our NOA2, my fiancé wants to file FMLA. Will it affect our immigration process?

No it would not affect the I-129F approval (NOA2).   

 

Unpaid leave could affect could affect the financial support requirements for the actual visa application at the embassy later, depending on how much time was taken as leave of absence.

Oh no. How can it affect financial support requirements? Like the paystubs for the last 3 months? Would the W2 and Tax Return Transcript suffice? 
 

He plans to FMLA for 3 months. We got our NOA1 last August and we are expected to get our NOA2 in November. We might have our US Embassy Visa interview scheduled in December. He wants to file for FMLA in November until January.

He plans to FMLA for 3 months. We got our NOA1 last August and we are expected to get our NOA2 in November. We might have our US Embassy Visa interview scheduled in December. He wants to file for FMLA in November until January. 

For just a few months it may have zero effect.    For the Philippines, the embassy wants your most recent tax return/transcript and W-2  .. if the gross income exceeds the I-864P income requirements, you should be just fine.
