Timeline

Hello guys, so we did end up getting a Request for Initial Evidence regarding our AOS application. I will attach photos of what they are asking for. Please can you help me what I should include in my response? I just want to be extra careful with this so decided to post for extra help. 

 

Also on the same day we received the Biometics appointment letter. We should attend this normally, right? The RFEI is giving us 87 days to respond, should we respond before our Bio appointment on the 29th of March? 

 

Additionally, does this delay our AOS or does it delay our EAD and AP as well? 

 

Here is what I included on my Affidavit already: 

-affidavit

-proof of citizenship

-letter of explanation on why i wasn't required to file taxes

-letter from employer

-job offer letter

-pay stubs of only 2 months (the reason why I probably got RFIEd)

Yes if you had no taxes to submit and you want to report Predicted Income as your Current Income using an Employment Verification Letter you will need 6 months worth of paystubs too.

If you dont have that you will need a joint sponsor.

Yes you can still go in for your biometrics as it has  been scheduled. Per USCIS policies, RFE or RFIE put a hold on the EAD/AP  until you submit your response to RFIE. The IO working on your case will make a decision on the RFIE within 60 days. But the decision on RFIE can take from few weeks to months. I hope others throw more light on how to handle the RFIE

Hi OP,

 

My husband I received the same RFIE as you last year.

 

Looking at your post, it seems as though you didn't meet the requirements? Does your job [now] make the requirement? If not, it is best that you get a co-sponsor to help you out get exactly what it states in the letter. I would get the last 2-3 years tax returns, last 3 months pay stubs, a letter from employer(s), etc.

 

This will put a hold on your EAD/AP until you get this sorted out.

Yes, you should attend the biometrics as normal and respond to the RFIE before the deadline. The two are not dependent on each other.

Yes, until you comply with the RFIE, your EAD and AP processing will be put on hold.

Hello, yes I make the required income over 2 times more. However I have only been employed for 3 months so far.

That might be the issue since you've only been employed for 3 months and you didn't file taxes for the previous years. I recommend getting a sponsor.

USCIS likes to see 6 months at least at a new job. One option is to wait until near the RFIE deadline (at 85 days, for example) to send your answer. Another option is to enlist a joint sponsor's help.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

That is what I would do is just wait until you have more documentation to prove that you will make more than enough for this year. Then submit that documentation in response to the RFE. Unless you can get a cosponsor and submit that documentation in response to this.

I got the exact same RFIE in February.

Same office, etc.

Had me scratching my head for weeks.

Submitted our package April 12.

No reply yet but the timing was good because it allowed us to submit  2018 Tax Return.

 

First time back on VJ for a few weeks.

Life almost returned to normal LOL.

 

Anyways,

It was only after I re-assembled our  papers with our  2018 Return  that I understood  the significance of "the most recent Tax Return".

I have not been around a long time here on VJ but I have a hunch USCIS  doesn't  like  asset applications unless they are far, far  in excess of the  requirements.  

Our timing allowed us to go on income alone by the time we got the 2nd RFIE so it -fortuitously- worked out well  as we could submit the 2018 Return.

So much easier putting the package together. Documenting assets and length of time ownership, it gets crazy after awhile.

 

Still waiting for our AOS decision. Ned
