I've had to explain the visa process to many people....many times and it is kind of confusing for them. I have thus developed an explanation that everyone can relate to. Here it goes:

When you break it down, we are all looking for a BJ (Beneficiary Justice). Now, the government doesn't just give BJ's to anyone. In order to get a BJ, you first need to sign a document that you have intent to marry. They need to know that this relationship is serious before considering a BJ. They will run some background checks, etc before they put your information in their @SS (Adjudication Speed System). Once in their @SS, you could run into some problems......this is known as getting stuck in the @SS of the governement. If they don't like your answers to some questions, you could be put in a FU (Follow Up) status. They do this because they want more information before giving the BJ. They don't give BJ's to liars.

In order to avoid the FU status, a medical exam must be performed to see if it is safe to give the BJ. If that is safe, the next step for the government is to make sure once the BJ is given there is a high probability that you will get married. They take these BJ's very seriously.

In the event that all of those things do not work and the government still puts you in the FU status, all is not lost. You can appeal to the government for the BJ. You can also look for loopholes in the PJ (Petitioner Justice) to see if a BJ can still be performed.

If everything checks out and the government concludes that you are medically and financially ready, they will give you a BJ......and it is well worth the wait. A BJ from the government can lead to a lifetime of happiness.

Latest steps:

10/26/2006- Consulate receives case (seriously, one month to receive the case?? BS!), and packet 3 that I sent even before they had received the case.

01/02/2007- Interview!!!!!!!!!!!!! Got a 221(g)

01/23/2007- Second Interview. VISA granted!!!

01/29/2007- VISA arrived.... no envelope though. I'm gonna contact them and see what happened this time!

01/31/2007- I'll have to send them one last financial support evidence.

02/01/2007- Evidence sent

02/02/2007- Evidence received by Consulate

02/06/2007- Consulate sends envelope!

02/07/2007- Envelope received!!!

02/10/2007- Flew to the USA!!!!!!

04/17/2007- Wedding day!!!

Of the most common misconceptions I've been hearing... and I admit, I thought that way before as well... was that if I wanted her to stay here with me... I could just marry her when she came over for a visit.. and she'd automatically be allowed to stay - never heard people think she and her daughter would be automatic citizens...

I really really wish this one was true.... save us all some time and money :-)

Dec 20, 2005 - NOA1 Notice Date

Dec 27, 2005 - NOA1 Rcv'd in Mail

Mar 10, 2006 - NOA2 Approved

Mar 23, 2006 - NVC Received Packet

Mar 24, 2006 - Case Forwarded to London Embassy

Apr 7, 2006 - Recieved Packet 3

May 11, 2006 - Packet 3 Sent Back

May 24, 2006 - Medical Appointment

May 24, 2006 - Packet 4 Received

Jun 14, 2006 - Interview - APPROVED!!!!!!!

Jun 16, 2006 - Visa Recieved

One of the scariest things I found out when talking about the whole process is that a lot of people don't even know what a visa is.

Example:

Other person: So Jenn, I hear you're engaged! When are you getting married?

Me: Well, we're not quite sure. It depends on when his visa comes through.

Other person: (blank stare) I see.

I swear they thought I was talking about credit cards....

That was great!

I don't think anyone realizes how frustrating the visa process can be. I keep getting "Is your husband here yet? Is he here yet?". And when I explain there is a lot of paperwork and time and patience involoved, they are confused. "What? He can't just come here?"

Second worst is people who went through the process ten years ago and they keep telling you how they got their visas within 4-6 months, how easy it was and that they were LPR upon arrival. Whereas it has taken us 7 months just to get a K3.
