I was looking at the guides, but I am confused:

My fiance will soon go for his interview for the K-1 visa.

When he arrives here, when does he apply for the Adjustment of Status? Also, does everyone who comes here on a K-1 visa also need to apply for an EAD as well? I think that has to do with a permit to work? When do these applications take place and do we need to be legally married first? Thanks

See the I-485 form instructions for when to apply for adjustment of status and what the requirements are.

A person only needs to apply for an employment authorization document if they want to become employed prior to becoming an LPR. Although an EAD can also be handy for obtaining such things as a driver's license in many states. As with adjustment of status, read the form instructions to find out the requirements.

After you are married. You must be married within 90 days of the intending immigrant arriving in the USA. After that you should file for AOS ASAP, but it is not required to before the expiry of the K-1.

Also, does everyone who comes here on a K-1 visa also need to apply for an EAD as well?

Its only required if the intending immigrant wishes to work while waiting for their Green Card. It also helps getting things likea drivers license while waiting for a Green Card.

If your husband wants to work sooner than later than he should apply for the EAD. That can be approved quicker than the green card.

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil
