everyone is misunderstanding me, i wanna know if i apply for benefits will she lose permanent residence, and be deported as public charge. she omly has a small part time job, and we are struggling badly. i am unable to work right now. due to my car accident.

Deportation doesn't work like that and it does not happen for those reasons.

Where are you in the process, have you been interviewed?

It has lots of variance, do you have any asset and number of member in your family?  SSA will require you to submit you bank statement, doctor statement, etc...

Difficult to comprehend how on one hand you are struggling badly that you are asking about disability, Medicaid, and food stamps.  Then on the other hand you plan to fly your wife to her country to attend a graduation.

Not sure anybody can help you without knowing your situation, if you have not be interviewed, you have not had to meet the sponsorship requirements sounds like you will need a Joint Sponsor.

Then you are probably OK.

Go to SSA and your state Department of Human Services to apply for your benefit.

Also, you could go to ssa.gov to get your monthly estimated disability benefits and apply online.

just dont want her to lose permanrnt residence and or be a public charge. its the AOS green card not full green card.

It is a GC but the GC she gets will only be a 2 year GC after the 2 years you guys will have to remove conditions (ROC) to get the 10 year GC. So maybe start saving up for that a little at the time.

Also so agree with above seems like your priorities are all wrong when you hardly can afford to live, don’t have insurance or anything.

Yes she wants to go home but accident happened and priorities have to be changed.

Paying plane ticket seems so wrong. Help her find a full time job instead!

Sorry but the original post wasn’t very clear and further postings convoluted. You do not need to worry about her being deported. Currently, Medicaid and food stamps are not considered for public charge purposes. Just make sure you follow through w whatever you are submitting for her AOS. 🙂 good luck.

As a USC you are entitled to any benefit any other USC could get, she is considered a public charge if SHE ends up getting those benefits in her name because you couldn’t provide.

while yes, she will technically benefit from any benefits you receive, as long as she isn’t the primary receiver it’s fine.
