I called the NVC, after 4-5 mins got to talk with a polite lady. was told that my case was recieved on last friday, assigned a case no, and going to fwd to local consulate by this weekend or early next week :thumbs:

When you cld they would have told you the case #. My case was recv'd on the 21st but a # wasn't assigned until yesterday. Give it a few days.

My I-129F and I-130 have been aproved on 05/24, which I was notifeid by email, but have not yet received NOA2.

I called NVC today and they have not received my case from CSC...

Hopefully NVC will receive my case soon but this kind of delay in administrative work is always very frustrating even I know they are slow.

I know US Tokyo Embassy is well operated so I want my case to be forwarded to the consulate asap.

I have a question for the forum. I am getting conflicting information from what my lawyer is telling me versus what the NVC representative is telling me. I received an email from CSC saying that my I-129F was sent to the NVC on the 23rd of May. From what I read on the FAQ and K3 guide in VJ, once the NVC receives the petition it is assigned a case number and then forwarded directly to the embassy. My lawyer is telling me that is not true. She said once the NVC assigns a case number, it is sent back to us with a packet that we have to complete (AOS) and send back to the NVC and then they forward to the embassy.

My situation has another twist. I have also filed for the I-130 and the NVC sent us the bar coded packet with the DS-230 and I-864 on 5/22 (we still havent received it).

My primary goal is to bring my wife here as quickly as possible since she is 5 months pregnant.

In my opinion, the K3 will be received in Venezuela before the I-130, but my lawyer thinks otherwise. If the information in the FAQ is correct that the NVC directly forward to the emabssy, the I-129 petition can be there as early as next week. Since we still havent received the I-130 packet yet, I am predicting it can take up to anotjer 4-6 weeks before the I-130 gets to Venezuela.

Can somebody help clarify? What would you guys do if you were in my situation?

Your attorney gives you information contrary to the understanding of this board. You filed a I-129F, right? NVC has the approved I-129F, right? It will go on to the embassy and your spouse will be interviewed for a K3. When the I-130 is approved, it will be retained. Your attorney, if he/she is worth an ounce of salt, should know this ....

NVC got my petition Tuesday and by Tuesday night they'd assigned it a MOS number.

edit: gorockogo1, as I re-read your post, I'm not so sure I'm right. You haven't filled in a timeline, so it is hard to understand your situation, but it seems you have both an approved I-130 and an approved I-129F. And, contrary to most recent experience, it seems you've gotten some requests for NVC for paperwork pursuant to the I-130. It would help if you gave us more information and filled in your timeline. Perhaps your attorney has found a way to keep both petitions in play, even though USCIS says their practice is to send the I-129F on to State for processing and retain the I-130...

What you have is the designation of agent form and then they will send you a bill for the fee. These things still need to be done before the I-130 is forwarded to the embassy, do not know how long but you are still looking at 3-4 months more or less. I-129F will make it to the embassy well before that. From what I have read here in the forum, is that, if you have a pending I-129F interview and the embassy receives the I-130, they will reschedule you for a later date and process the I-130. Going the I-130 route has its benefits, as she will get a green card soon after arriving and will be able to work. For the I-129F your wife will need do the Adjustment of Status (AOS) before she gets her green card. Lately USCIS has been holding the approved I-130 here and just forwarding the I-129F to the embassy, i am guesing in your case there must have been quite a gap between filing the I-130 and I-129F. Plus you need to figure out how far your embassy is scheduling both types of interviews, which will give you an idea on the time frame. Hope this helps. I am not a lawyer, these are just my opinions. I would go for the I-129F since its already on its way to the embassy, send in the Agent form, but hold off on paying the fee.
