Yes I came with tourist visa my Dad applied for me .Me and my ex went to same high school in Haiti .so

he came first and I me after we get married

so you came here on a tourist visa with the intent to stay and adjust status?

 

or did your ex husband bring you to USA on a spouse visa?

 

were you ever considered a LPR?

I came with visa for 4 months only so haiti had the earthquake same time I supposed to go back to my country .i got approved for TPS so my ex proposed me to get married .we Dd but never file the Adjustment for me and he told me stop renew my TPS cause he s gonna fils the Adjustment he never did

So I called a lawyer explain him what he Dd .the lawyer told me to file I360 cause I got abused

okay so now you have overstayed your tourist visa, and out of status, no longer married to the same man who was suppose to file adjustment of status for you so you attempted to adjust status on your own with a VAWA waiver am I right so far?

 

and now this waiver has been denied because you did not furnish tax transcripts for those years?

 

now you are engaged to another man?

it appears as if she came on a tourist visa but never left, husband proposed, they got married, but never filed for AOS, so she is out of status attempted to file VAWA on her own, but failed to meet the requirements now she has a new USC man she is wanting to marry.

 

I would presume she would be able to do that with the new USC husband would be able to file for AOS for her, but its been a long time, she might be in deportation proceedings? maybe?

Yes I file the wava cause I got abuse verbally.i got denied yes cause I don’t furnis the tax transcripts.so I m going to married to another man this month .cause of the wava I ddnt do it earlier

Dunno about deportation but adjustment in this case is possible, the iffy VAWA may shall we say cause a closer look.

get married file for the AOS.

 

the denied VAWA case is going to cause your AOS filed to be closely looked at so make sure you have strong evidence with the new USC husband

Pregnancy isn't evidence it just shows you had sex

 

your going to need a lot more evidence financial documents, time spent together shared home proof

You might be surprised to see how many people ask if pregnancy will get them special consideration or faster processing......It will not.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
