:help: So I'm talking to my husband tonight and reading something to him that I came across on the New Delhi Embassy website about the importance of making sure your surname and given name are on two different lines. Hubby then responds to me that his is in order and then casually mentions that his last name is spelled wrong on his passport. Instead of a Ayilliath they spelled it Ayyialliath. That information I could have handled okay if he had not followed it up with "So I've been spelling it that way on all of the documents I've submitted to the embassy" WHAT?!! was my response.

He just got this passport renewed in February. My question to him was why didn't you get it corrected immediately when first got the passport? He said he didn't notice it until he had reached back to Delhi (from Kerala where he had it renewed). So I begin to explain to him that he should have spelled the name correctly on all of his forms that he submitted and the importance of him providing CORRECT information to the embassy. He says he was told by the person at the information window at the Embassy that he should submit the documents as his name appears on his passport. I explained to my husband that everything I submitted to USCIS has the correct spelling and that by his submitting it incorrectly it could be frowned upon by the embassy. I explained that name checks are based on this thing called the spelling of your name and that his error could cause him to be placed on AR or AP while they try to figure out what's going on.

Now we're trying to figure out the best way to handle this. Just through the grace of God he had JUST arrived back in Kerala only an hour before he told me this because he has to get the PCC stamp from the passport office that wasn't put in there when he renewed it in Feb. I say to avoid any issues we call the embassy and advise them of the correct spelling now before his June 11 interview and have it corrected on his passport while he's already at the passport office. My husband thinks that he should just have an affadavit done saying that his last name is spelled both with one y and 2 y's. I keep trying to explain to him that what may seem like a simple misspelling error can cause a great deal of delay for us and that the documents have to be correct because his social security card etc are going to be based on this here in the states.

In addition to this being a vent post because I CAN'T BELIEVE my husband hasn't said anything about this prior to now (he says he forgot with everything else going on) I'm also wondering if anyone has any suggestions on the right way to handle this. Thanks.

That's a tough call.

Maybe bring it up at the interview...

His birth certificate is needed at the interview. I'm sure that it will be noticed that there's a mismatch. But then again they may not notice it at all. Your name isn't that common so they may accept a small type-o.

I'm not sure on this one it could go either way.

LOL :lol: Liz I SOOOOO needed that laugh. You're right. The way I feel with hubby right now Boys ARE dumb. LOL. I just talked to the American Embassy twice (I was surpised to have gotten through twice in a row but God is with us) and to make a long 10 minute conversation short, he needs to have it corrected on the passport because it has the potential to cause delays and of course all of his documentation will be wrong. The way the person I spoke with explained it, the final decision as to whether or not to delay the visa issuance would be up to the interviewing officer. That's a chance we just don't want to take.

In the meantime hubby was still at the passport office getting his pcc and they told him that in order to have the error corrected he would have to have the passport issued AGAIN which means he has to pay for it again etc....but he said he would do whatever it took to get this straightened out. He knows wifey is unhappy with the situation so he's being extra sugary sweet. LOL.

Hopefully my honesty on the issue with the Embassy will be rewarded with a quick visa. I truly thought about not doing anything about it at all and just seeing if the error would go unnoticed or they would overlook it but in today's times of increased security checks etc, I just didn't want them to think we were purposely trying to give incorrect information.

It is very fortunate you got through to the Embassy. Getting the passport corrected or reissued if that is the only way to correct the name is the best bet. Any name checks should have been completed by the time the lase left NVC, using the correct spelling. His birth certificate and police no crime report should also be in the correct name. Once the visa is issued and he arrives here, it is too late to correct the passport. You can imagine the complications going forward. I hope his passport can be reissued before your June 11 interview. If not, you may want to reschedule the interview.

Just an update, my husband has to get a new passport with the correct information issued. The supervisor at the passport office told him to submit all of the paperwork for the corrections on Monday and he would have the new passport with the PCC stamp within a couple of days. They were also kind enough to let him pick up the passport from the office instead of having it couriered as they usually do in order to expedite the process. Hopefully this will take care of everything. But I thought there were more name checks done after the case reached the respective Embassy. That's why I was freaking out because I didn't want it to appear we were trying to throw them off on the name check.

thanks everyone

Additional name checks CAN be ordered at any time including after the interview. However, the norm is to complete K visa name checks while the case is at NVC or at least BEFORE the case file is on station abroad. That same name check is not even requested for CR1 or IR1 until the case file reaches the Embassy or Consulate because there is not enough information in the electronic file. As senseless as this sounds, that's the straight poop.

Unless something in the visa application itself, from third party correspondence or in the interview prompts an additional name check, there isn't one.

It is so frustrating to be delayed by a clerical error. They had a spacing error on our sons visa under the one spot so basically it had Nam EILast. The embassy told us it was no big deal and they didn't need to fix it.

But don't feel bad it's not limited to USA gov't sloppiness, on my UK visa they had my maiden named spelled completely wrong, but I never noticed it until I was in the UK, and neither did the immigration person when I went through Gatwick :P

I'm happy it's a quick fix! Good luck with everything.
