When to marry during the 90 days?

All children must have an SSN or ITIN to be claimed on taxes (or the much less common ATIN). This requirement was put into place decades ago...and all of a sudden a bunch of children were no longer being claimed.

Timeline

Thanks so much for the help!  We have come to a decision about the wedding date. We're going with March 15th. Since this is coming up very soon, does it make more sense to wait on the SSN until after the wedding? She intends to change her last name after the wedding.

The general suggestion is to apply before marriage, then update it afterwards. The reason being SSA staff sometimes give people a hard time on using a married name until you have documentation from USCIS/DHS in that name. And it's better to have a card in the maiden name than possibly none at all for several months.

Timeline

Thanks for the input everyone. So the plan is to apply for my fiancées SSN this week or early next week. The wedding will be next Friday, March 15th. After the wedding, I will apply for AOS along with EAD/AP for both Mom and son. If I understand correctly, the son cannot apply for a SSN until after he has his EAD documents? Does he also need his AOS approval prior to applying for a SSN?

He can apply for an SSN with an EAD or green card. He doesn't qualify for one with only K-2 status, though.

Ok..

Mom (K-1) can apply for her SS# immediately  after arrival.

Boy (K-2)  - can not.

 

After marriage you are sending out AOS paperwork, for both, and along with AOS submission you are including EAD/AP applications as well . For both.

 

EAD/AP usually gets approved within 4-6 months, while AOS (I-485) takes up to a year or even longer. That's the purpose of applying for EAD/AP while your I-485 pending, so you could work and travel.

 

Once kid's EAD/AP card arrives, he can apply for his SS#.  No need to wait for his AOS approval. Unless  a miracle happens and their I-485's  get approvals before EAD/Ap.

Timeline

And success! we applied for her SSN and were married this past Friday! I took one day of relaxation and now I'm reading about AOS.

 

Is there any reason to wait for her SSN before we apply for AOS? Also, she plans to hyphenate her last name with mine. Should we officially do this before starting AOS?  Keep in mind, we are also doing AOS for her son who came here on a K-2.
