Hey guys,

 

about a week ago I made this post on the forums

 

Basically our petition had been sent to the appeals office in Washington by mistake. They told us on the phone it was an error and sent it back to the California service centre for processing. 

 

Our NOA1 is from early March and I know that the wait times for NOA2 are long but I can’t help but to compare with others on this thread. I’m surprised to see a lot of people who already have their NOA2. Should I be optimistic? Is it likely to be prioritised if applications from a similar time frame have been processed?

Ah okay. Well I'll scan the whole passport and tag the pages with the relevant visa stamps. I also got the receipt from the hotel of my first trip there, and even a dated letter I wrote to Elif using the hotel's notepad which has its logo on it.

First week of July started on the right foot for Marchies! Can't wait to see what this month has in store for all of us :D ! 

Congrats to all whom received the approval you have been anxiously waiting for! 

@rita&vinnieI know you have been waiting for that approval for the entirety of June and surely it mustn't have felt too good to see others be approved after you but alas! You're with us now :jest:

@Whipz We went through the same circumstances prior to getting our NOA2's it seems, feeling sad while unbeknownst the us the petition had already been approved lol.

From the K-1 Visa guide on VJ itself: 

1.

Copies of all airline boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years. You may want to highlight or place post-it notes indicating the dates and locations on the copies (to make the adjudication easier) for the person reviewing your file.

 

Also, something that I'm not too sure on whether it helped us establish better or not that we met, it was me also scanning my passport in the page with my visa biographic information (to our luck, the lady stamped my last stamp there, even though she totally shouldn't have) meaning that I indeed had a tourist visa that I used to travel to visit him.

Those customs people with their stamps are so reckless! Yes I ended up scanning the entire passport. The order of which my travel visas appear in the passport are not in any chronological order. So I'll be sure to highlight the pages of the passport with the relevant visas.

Other than the stamps pages of both our passports we also sent I94 as proof of meeting for the past 2 years. You could also send letters from friends and family stating that they saw you both together (we asked both of our moms and two of our friends, one in each country).

Just now I was on the I94 website and I tried to get my most recent one. It said "No record found for traveler". I entered my correct passport info. Am I doing something wrong? 

 

Maybe I'm misunderstanding what these are for. My fiance has never been to the United States and I was trying to enter my own info. That's wrong, right?

This is the page you should go https://i94.cbp.dhs.gov/I94/#/history-search. It should show your records of arrival and departures, as far as I know. I don't see why your fiance never been to the US would be a problem. For our petition, we got my I94, my fiancé's Brazilian visa page, my own US visa page, both passports stamps pages showing that we went back and forth to see each other and copy of our flight tickets. Oh and the letters that I mentioned before + pictures of us together with friends and families. 

 

I don't know what you sent before but I would send it all again plus any other evidence I could find (like the letters)

They do have plenty of pictures. They just want evidence of the times I was there. The I94 still says it has no record of me. I tried the link you sent. 

 

Well I thought at any rate you're not supposed to send a bunch of new stuff. Just what they are asking for.

 

I wish I still had my boarding passes, but I suspect the hotel receipt of where I stayed in Gemlik, Turkey, the pages of my passport showing my Turkish visas, the dated letter I wrote on the hotel's notepad, and copies of the sent emails to Elif showing my itinerary will be sufficient that I was there when I said I was. Really, the Turkish visas with their dates on them alone should be enough.

 

Then I have my TOS from Badoo which my lawyer thinks sufficiently shows it's not an International Marriage Broker site. And we are getting new passport photos (I still don't understand this demand, but ah well!).

They just want evidence of the times I was there. The I94 still says it has no record of me. Your case is ready to be completed and based the information you reply with will give what the adjudicator is looking for so they can complete your case.

"You stated that you and the beneficiary met in 2018 and 2019 in Turkey and submitted photographs of you and
the beneficiary together to substantiate your statement. However, photographs alone are insufficient to
establish that you have fulfilled the two-year in-person meeting requirement.


Submit evidence that you and your fiance(e) have met each other in person at some time during the two-year
period from March 20, 2017 until March 20, 2019, the filing date of your petition. Evidence may include, but
is not limited to:

 

  • Photocopies of your passport and/or your fiance(e)'s passport, including biographical data pages and pages showing entry and exit stamps showing that you have both been present in a given location at the

same time."

 

This particular bullet point concerned me. I can prove I was in Gemlik, Turkey at a certain time with my visa stamps and hotel receipt. My fiance lives in Gemlik Turkey, though. She really has nothing to prove she was where she lives at the time of my visit. I think I may be overthinking this particular point.

You're overthinking it.  If that's the city of her residence, it would be assumed that she was there.  The secondary evidence (photos with a description of the location) should suffice as proof.

Also to add to this, travel history! 

I don't know if for @Elif_and_Greg this would work since, then again, he is the USC. 

But to whomever has visited their fiance within the United States and is unable to get their I-94, travel history within the i-94 webpage is as close as you'll get to showing that you truly did visit in the times that you have stated in your petition. 

Since I had a name change, I was panicking super hard since my latest i-94 only has the last time I visited with my old name, but we submitted my travel history (which didn't even show my departure by the time we sent out packet!) 

So perhaps this might be of some help to anyone 😊
