I have no idea what we did so wrong. We did add everything on the list; photos of us together, passport stamps, her divorce decree, letter of intent, passport size photos, and so on... All we can do now is wait for the mail, I guess. So frustrating.

My fiancee got the mail today, it was a NOID after all...... But it was for the same things we thought we had sent. We had an immigration attorney help us with the process and send the package for us so if anything went wrong before the mailing, it's probably his fault. We emailed him and are waiting for a response, will also call him tomorrow. If it really is his fault, I'm going to be so ###### pissed.

On the bright side, we do have a chance to fix everything easily since we already have everything on hand, so she'll probably mail the package tomorrow.

Sorry to hear you’re going through this. Hopefully everything gets sorted out quickly, and you can move forward with the process.

This is NOT a NOID. I repeat this is not a NOID. This is a RFE (request for additional evidence). Easily satisfied and may put you back 2 to 3 weeks.  This is not something to be MAD at your lawyer.  You follow the request from the letter and your onto the next step. Simple.!!

This is what we got. They're requesting things we were otherwise 100% sure we prepared (like passport photos and her divorce decree, for example)

 

We get it's easy to fix but it feels to me it shouldn't have happened at all.

Just another reason why not to use a lawyer for this process.

I got my RFE letter.

 

Seems there are 3 issues with my application.

 

Passport photos required. My lawyer should've included those, so either she didn't or the photos are not good. I'll check that tomorrow.

 

They want more evidence that we met within the 2 year period. So I reckon I can scan my Turkish visas for that. I had some flight information already sent in, but....I'm not sure what else besides passport scans that could be sent in. I could also try to get a receipt of the hotel I stayed at in my first trip. Damn, I wish I saved my receipt the time around. It might be in a folder somewhere, though.

 

Lastly, they want to know if the dating app Elif and I met on is an international marriage broker. We just met on that dating app called Badoo. I stated this in my intent to marry letter, but it seems they just want a statement from me indicating Badoo is not an International Marriage Broker. Fascinating.

This is definitely a NOID. When it says they intent to deny the petition they pretty much state it for you. These are a rare breed, but they do exist. Yeah passport photos are an easy fix. If your attorney did mail out the divorce decree it can be that they want one with an official seal. Once an officer was so picky about having official court records with the official seal, which meant the records could not be a copy. Sometimes official seals say they have to be in a specific color to be good. Some seals create some 3d effect on the paper so who knows. However, yeah you should first confirm that the divorce decree was actually sent with your attorney. If they are any good they have a copy of what was actually sent. In our office we make a copy of the forms with the attached evidence. We even make copies of the passport photos and money orders sent, so we can cover our butts when immigration says it was never sent. So if you can get a copy of what was sent that would be helpful.

Yeah if it was an RFE it says so on the front page of the letter. My letter just says at the top Request for Evidence.

So, is this one of those case where USCIS has discretion to deny due to missing essential items?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Sounds like it to me.  But yet, the OP states they were given a list of documents to send.  So in practice it's no different than an RFE?

This document MAY change things but without the remainder of the entire letter it's hard to factually respond to this. The post that I responded to that is an RFE is the one below. Can't opine much more unless I see the entire letter.

 

Let me ask you, did you get an RFE asking for additional documents, you responded with those documents and you received this letter stating "it is the intent of USCIS to deny Form I-129f" which is vague to begin with but I digress. Correct?

 

And, who sent the information from the RFE if indeed their was an RFE? You or the lawyer?
