Hello All,

I have a question. My fiancee has lived in Chile (for the past 5 years), but was born in Haiti. Will he be needing a police certificate/clearance from Haiti as well? Due to the unrest, it's been difficult trying to contact anyone there. Please help. I'm all ears.

Required for all countries where you have lived for more than 6 months since the age of 16 and any country where you have been arrested, even if you were not resident there.  U.S. police certificates are not required.  Police certificates from certain countries are unavailable or are obtained directly by your Embassy (rarely does your embassy execute this step).  Fingerprints are required for certain countries.  Foreign police certificates are valid indefinitely unless you have returned to reside in that country or has been arrested since the issuance of the certificate;

What Do we do with the current state of Haiti? Unrest in the streets making it difficult to go anywhere. He tries calling but can't reach anyone.

I would email the embassy and state your case and see what alternatives you have. If for any reason you can't get a document they sometimes will forego the requirement. With the number of people processing through their embassy and the knowledge they have, I am sure they have heard others that are in the same situation as you.

No but with millions standing in line to get a visa I am sure someone else has experienced this. I'm sure when he arrives he'll be asked what his business is and be escorted to her window once she is between interviews. Good luck. Please let us know the outcome. Whish you all the best.

So our 90 days is up 9/4.  We got married last week and I need to send in for the adjustment of status.  I am worried that I waited too long.  I need to get his birth certificate translated still- does it need to be notarized? thanks

Time for her to go back to her country and re-file for i-130 or stay here and file for i-130 and restart process.   You will miss this deadline.

I suggest, file AOS immediately and provide what you can. Get rfe to translate birth certificate if thats only option.  Do it ASAP and mail ASAP, express if needed.

you dragging your feet seems as if you have no sense of urgency...  DO IT ASAP  and mail it by Tuesday!!

The K1 visa allows the fiance of a U.S. citizen to enter the U.S. for the purpose of getting married. ... To stay in the U.S. after your K1 visa expires, you must get married within that 90 day period AND file for an adjustment of status to permanent resident.
