hi my wife has her ga license but it still expires when her k1 visa is suppose to expire but now we are married. i thought we only need marriage certificate to proof she is here legally now

I just rocked up to the DMV with my completed form (which I downloaded from the DMV website), my passport with K1 visa in, My i94 and my social security number. I was immediately given online access to book the theory test, which I did the following week and walked out of that office with my official Adult learner permit.

 

The following week I had to sit through a hideously boring 8 hour, one day driver safety course which is mandatory in Connecticut. 8 hours and $80 I will never get back! Hahaha!

 

The following week I booked and took my road test in my wife's car and now hold a full licence. Expires in 2025 I think! 

I think all the dates should be in my signature below.

I did it while my K1 was still valid (in fact my K1 is still valid now hahahaha!) Runs out May 5th.  I just remembered I also had to take in my UK driving licence of course. 

 

In CT if you have previously held a licence in another country you do not need to adhere to the 90 day waiting time between theory and road test - hence how I did it all so quickly.

No.  Legal presence is usually defined by most state DMVs as a Green Card or EAD, etc.

Did she pass her theory and road test to get that licence?  Everything seems so different from state to state but if she has passed the test I would assume it should be valid indefinitely.  It is best to check at your local DMV. 

@missileman Do you think CT is just an easier or more lenient state for getting a licence? Either way I am glad it is all over with lol

I'm not sure.  I do know that many, if not most, states only activate new K-1 driver's licenses until expiration of the I-94.  Legal presence evidence is usually defined as having a valid Green Card, valid EAD, Asylum documents, etc........

we went to our dmv earlier the guy was looking at her i94 and that’s what he was going by. she had her ga license when she was living here as an au pair

Weird 🤷‍♀️ All I did was follow the instructions from here: https://www.ct.gov/dmv/cwp/view.asp?a=805&q=514952 

 

This was the ID required checklist when I went to my theory test: https://www.ct.gov/dmv/lib/dmv/selectct/selectid_accpt_docs3.pdf

 

So I took: Passport, UK Licence, marriage certificate, social security card, printed I94 and a couple of letters addressed to me. One from USCIS and the other was something I had ordered from eBay I think 😂

There is a confusing aspect of ID / DL information. Right now all states are going through the process of using "Real ID" compliant ID cards. Those require proof of residence (CA uses utility bills, vehicle registration, property tax bill etc for that purpose) Marriage certificate ties USC and K-1 beneficiary together by proving that residence is valid since K-1 person will not have those utility bills etc. BUT the catch is Real ID will only be issued until I-94 expiration. "Non-compliant" state ID or DL though will not have a star on it, and is not federally compliant, but can be issued for 5-6 years (always expires at your birthday I believe) and doesn't require those proves of residency.  In general as all things government it is unnecessarily confusing and convoluted. 

 

At this point I am really happy we were able to get State ID that is good for next 5 years or so, which means she can freely walk outside without having to carry her passport.

No.  Marriage is not proof of legal presence.    A person with a valid I-94 has legal presence.......until the I-94 expires.
