Yeah. If your spouse income is high, you don't need to give the last 3 years income. We did it anyways just to proof that my husband is stable financially.

Hey guys, im about file AOS in april but before the 15th where tax season ends. Can we still use the tax transcript for 2017 or should i wait until my husband gets his 2018 transcript?

The officer however might issue a RFE if they needed paystubs. I knew people that were scheduled for interview and all they have as financial evidence is their 3 years tax transcripts and W2s.

We included the tax transcript (one year) for I-864.  Is that enough?

Me too...we only included one year of tax transcript.  Is that enough?

I only sent tax transcripts, which should be sufficient. But they wanted the latest tax return, thus the RFE

Transcript are fine, so long as you have 2018 returns, you should be set

We didn't include any paystubs at all. We just included my most recent year 2018 tax transcripts.  Technically if your spouse earns way above the poverty line, last year tax should do it. But we were told by our lawyer to include the last 3 years transcripts as it would show that my husband has a consistent and stable source of income for the past few years. The lawyer said that for our application he believe that ours was good without paystubs since we only have 2 months of paystubs for the year 2019 when we file our application. He did mention that when we do get our interview notice that's when we have to get a copy of 3 months most recent paystubs.

If i were you, I would wait. Some here that file earlier in the month already gets RFE asking for 2018 transcripts. If you don't want to wait and already file your return for 2018 you could just submit your returns (form1040) and w2s instead of transcript for the 2018.

that sounds good. 

Ill include tax transcripts from 2017, and the stuff he got for 2018. Was already worried that we have to use the transcripts, but sending the form1040 and w2s (or however they are called when youre self employed) sounds simple. 

 

I honestly really love this forum and its helping members, because all this paperwork is so stressful and complicated especially as a foreigner.

I honestly really love this forum and its helping members, because all this paperwork is so stressful and complicated especially as a foreigner. 

When we consulted my lawyer the first time around January we had 2017, 2016, and 2015 form1040s. It was just a single page for my husband since he uses 1040ez and his taxes are relatively simple. Our lawyer asked us to consider adjustment of status after we had our taxes done since we can file jointly for 2018 (we got married in october) and that would be a good evidence for my I-130 application (i submitted my application concurrently as i've been in US when i met and married my husband). When we file our tax returns in February, I ended up with this huge pile of paper, so i just went and get transcripts for everything, consulted our lawyer a second time and he's ok with either form1040+W2 or transcripts.

Our packet was delivered on the 15th of March. Got the text messages (6 of them lol) on the 21st. Online case status shows that the EAD and AP were received on the 15th and the AOS was the 18th.  I"m hoping the NOAs will come next week? Does that seem right?

 

Unrelated question--we went to get his learners permit today (does not have a foreign drivers license so starting from scratch). Only took two trips to the DMV because despite calling and checking the form and online, they said they needed a print out of the I-94 and my passport to honor his K1 visa, plus the marriage certificate (which they didn't even tell us we needed to bring back, but we did anyway, and then they said we needed it on trip #2). He passed the test (yay!) but the guy at the DMV said the license is only valid for one year. Once you get the green card you have to get a new license. I asked what happens if the green card hasn't been issued in a year (that seems overly optimistic given timelines...our K1 visa took ONE YEAR) and he said "you need to take that up with immigration, but your license will expire." Anyone know how that works???? More hoops...it's definitely not a game for the impatient!

Hi, when did you send out. I mean what date. And did they give you a case number before the RFE
