Hi everyone,

I cld NVC on this already but just wanted to get other members opinions since we are know the reps are known of giving out misinformation. :whistle:

1) I'm moving the first week in June but to another apt within the same bldg. Should I complete a I-865 form (Change of Address) or wait until I send in the DS-3032 w/the correct address on it?

2) Also I was looking at the I-864EZ to get familiar with it but I wasn't sure on the household count. I filed for 3 ppl on my 2006 tax return. My husband, my daughter, and myself. Do I need to include my step-son in the household count? I'm going to file for him next year once we get situated.

I-865 does not yet apply to you.

Are you supporting your stepson (is he dependent on you)? Even if you are you probably can't claim him as a tax deduction - read the form instructions with regard to determining household members carefully.

1) How does the I-865 does not apply to me? It's the change of address form?

2) I help support my step-son. No I didn't put him on my tax return or looking for a tax deduction but the forms clearly states I must include all children. It states even if they're not on my tax return, residing w/me, or if I'm not legally obligated. Well, my income is ok regardless if I do claim 3 or 4 in my household. I just don't want this to come back and bite me in the you know what.

I didn't want my DS-3032 with an unknown (= new address for my husband the petitioner) address to be a source of confusion, so my husband faxed his change of address right after our case landed at the NVC and they confirmed the change about 10 days later. Which I thought was very fast and accurate :)

I got the fax number from the automated phone service message, btw.

Timeline (2nd):

5/29/2009 - Filing I-751 Removal of conditions

6/01/2009 - CSC received I-751

6/04/2009 - check cashed (fast!)

6/08/2009 - received I-797C (receipt date 6/01)

6/22/2009 - received Biometrics Appt. Notice

7/01/2009 - received rescheduled Appt. Notice

7/23/2009 - Biometr. Appt.

7/24/2009 - A touch, a touch!

8/20/2009 - APPROVED! Oh, glorious day!

8/25/2009 - Card production e-mail received

8/31/2009 - Card received. Error :(

9/05/2009 - Returned green card with evidence of error & I-90

9/16/2009 - received I-797C (receipt date 9/14)

10/27/2009 - Correct card issued

1) You don't need to complete I-865, because your spouse is not in the USA yet. In future, you will need to complete I-865 when you move and if your spouse will be in the USA as a permanent resident at that time.

2) Based on your description, you should include your step son in the household count.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

So clarify, AFTER my husband arrives in the states and we move I will need to submit the I-865 at that time?? I'm sooo confused!!!

Yes, you got it. He will also need to complete AR-11 (change of address form). You don't need to complete AR-11, since it does not apply to US Citizens. You will only file I-865, should you move after his arrival in USA.
