Canceling K1 Visa and Getting CR1

This info was given to you more then once in your former thread. My point is, if it's given there, there's no need to ask it again in a different thread. Also, there's tons of guides on VJ to help you through the process.

Ok ok. You know the answers to your questions. She still can’t work or travel until at least 4-6 months after she comes on K-1. If you decide to file CR1 it will be more than a year until the visa interview but she will enter as LPR and can work  and travel on day 1. That’s how it works.

All the pertinent has already been given in your previous thread. It's clear you didn't do proper research before embarking on the K1 and now everyone's giving you the right information, but it doesn't seem to be sinking in, which is only doing you a disservice as you and your fiancee could be spending this precious time to make a decision and to start preparing for the next steps:

 

1. An immigrant needs an EAD or green card to work. Otherwise, they are NOT allowed to work.

2. There is NOTHING you can to get around this fact. It is the LAW.

3. If you want to cancel the K1, you need to email the embassy and USCIS and tell them formally you want to withdraw the K1. 

4. Once that's done, you guys can get married wherever and start the CR1 process.

Timeline

It seems like paying for the cr1 after paying for the k1 already AND paying rent on a place in china would cancel out any potential savings? Why not enter on the k1, pay for an empty place, and she'll be able to work in like 6 months after you submit the AOS

 

When does her lease agreement end? Knowing this visa was coming to a close she certainly wouldnt have signed a year lease recently, right? So is this debate of cancelling the k1 over only a couple months rent?

My K1 visa interview - April 3, 2019 = APPROVED!! :D       EAD & AP approved - Feb. 6, 2020

Visa on hand - April 8, 2019                                                      EAD/AP combo card & SSN card in married name received - Feb. 13, 2020

US entry - July 31, 2019                                                             Green card interview scheduled - August 11, 2020

Our wedding day - Oct. 14, 2019 ❤️                                        Green card interview - September 10, 2020 = APPROVED! :D

                                                                                                       Green card received - September 16, 2020

NOA - July 14, 2022

Fingerprints Were Taken NOA - August 2, 2022
