Haven't received biometrics appointment after 4 months of applying for EAD

Hi,

 

I would like to ask your opinion on what I should do on the following situation:

  • I applied for AOS, EAD and AP after getting married on a K1 Visa. This was done on October, 2018.
  • I got the receipt number through SMS since I sent form G-1145, but I never got the receipt NOA through mail.
  • I called USCIS and they found that my address was entered wrong (it was filled correctly on forms). They fixed the address after this call.
  • After 4 months I haven't received a biometrics appointment, and looking at the timelines here on VisaJourney I know it shouldn't take more than 2 months for that.
  • I called USCIS, but they say they can't do anything, and I can't complain before I haven't received my EAD/AP past the 6 months they say it takes on their website. Also, the offices in Texas are not scheduling Infopass.

 

I should get a job offer in the next week, and the company expects me to receive my EAD in the next 1,5 months. If I get the job offer I will apply to expedite my EAD, but I'm afraid that something went wrong with my case and that even expediting it, it will take longer than 1,5 months to receive it.

 

Does anybody went through similar, or have an idea of what I can do?

I don't think you can expedite an EAD prior to biometrics being done. First you need to persuade someone at USCIS to look properly into your case and issue the biometrics notice, perhaps one was already issued and sent to the wrong address due to their typo (same could have happened to the NOA1s)?

That could be the case, but wouldn't they be able to see on the system that a biometrics appointment was sent? Or wouldn't it show on my USCIS online account? 

The person I talked to on the phone today put a request for a Infopass, she said that they should call me within 72 hours to confirm. If that doesn't lead anywhere I'll call and ask for a tier 2 person.

Anyways I'm going to talk to the local congressman office on Wednesday and see if they can help me.
