Hello, I'm patience waiting for the I-130 NOA1 like many people on this forum, but someone just told me that we may be able to file for the I-129F without the NOA1 letter.

I got the WAC# from the back of the check and I went online on the USCIS web site to see the status (it's pending) but I was wondering if anybody knows anything about this option.

Maybe we can print the online info wheres says the number and service center location ?

I appreciate any information you guys may know!!! :help:

If you already have the receipt number for your I-130, that means that your NOA1 has already been issued. Your NOA1 is that notice you received in the mail telling you your receipt number. You are free to file your I-129F since you have your I-130 receipt number now.

Sorry, can't edit this in, just noticed that you mentioned that you haven't received the paper copy of your NOA1 in the mail. If you already have your receipt number for the 1-130, that is all that is important, since they want you to write that receipt number on your I-129F petition. Now that you have that number, you are free to file.

Misty1979 just one thing they do not need the official letter???? the I-797 receipt actually with the I-129 package?

or should I print the page that I got online??? I dont even know how this letter (NOA1) looks like, theres some other info on the NOA1 witch they may need?

Sorry for all this confusion questions I'm just like everybody waiting and trying to make everything right to go back home1

Quoting your case number for your I-130 is evidence that you have filed already, since they can just look it up in their system and see that you have a case pending. If you are including a coverletter with your I-129F, that would be a good place to put your case number.

A similar question was asked on the 3rd page of the April K3 Filer's thread. Here was the response:

I have seen at least one member say here that they filed without the NOA1 copy, just writing a letter explaining that they never received it and providing the case number. You could try the same, but if your check was cashed, you should be getting the NOA1 soon.

One forum member was successful, but I have not found the thread again. Maybe this member will reply to your thread.

Another thread says to wait because a copy of the NOA1 is to be sent in the I129F package.

Possibly a well-written intent letter including the receipt number and explaining that the NOA1 has not arrived will suffice. The fact that only one forum member stated this method was successful leaves some uncertainty.

You're welcome:) I had the same problem, so that is exactly what I did, and it worked for me. Hope you get your NOA2 soon as well!

A photocopy of the front and back of your check should provide sufficient proof you filed.

Have you tried calling the service center? Since about 4 weeks have passed, my guess is that there is a good chance you will get the NOA1 in the coming days. Wait till Tuesday and if nothing shows up, go to your plan B as stated above.
