2 speeding tickets in last 3 years and FORM N400

Hello, 

 

Should I say yes to "Have you EVER been arrested, cited, or detained by any law enforcement officer (including any immigration official or any official of the U.S. armed forces) for any reason?"

 

if I have 2 speeding tickets for both less than $500? 

 

I have seen people saying yes and no so I am very confused.

It also says do not include minor trafic infractions, so no, you do not have to include speeding tickets less than $500.

When I was naturalized, I had half a dozen tickets of a variety types including speeding, not wearing seatbelt, not have car inspection, ... and GOD KNOWS how many parking tickets...

To clarify: you can include those if you want, but you don’t have to.

You always have to include everything on the N-400. 

 

You just don't have to provide documentation for any traffic offences for which you were only fined under $500 or received points on your driving record, were not arrested, and did not involve drugs or alcohol. 

 

This is clearly stated in the N-400 instructions.

My husband had two traffic tickets. We said yes, noted they were under $500, and took all the documentation with us to the interview. They never asked for it. We said yes because, well, yes he was given tickets.

You have to disclose it on the application---a speeding ticket is a citation ("cited").  

You don't have to provide documentation on it, since each ticket fine was less than $500.

 

There is no potential harm in having traffic violations on the N400 (well, unless there are multiple speeding violations over a short period of time raising questions about the GMC requirement, or includes DUIs).  The IO will be more concerned about whether the ticket fines have been paid, in this instance.
