Mistake on DS-260-Worried

So last night I submitted the DS-260 for my husband. He noticed this morning that I had checked "no" to the question " Have you ever been arrested or convicted for any crime even if later granted a pardon, amnesty or similar action?" When it should've been "yes". He had to go to court 6 years ago after an altercation with a relative but was forgiven and never served any jail time. He was required to pay a $300 fine (which he has the receipt for) and a waiver was given to him showing he was not convicted of anything. Also his police and court record are both clean (he has a govt job now for 3 years which he wouldn't have been able to obtain had his record had any negative marks on it). He told me about this last year and it's my fault I forgot. I'm really worried and I hope this doesn't ruin his chance of getting approved now.  I told him he should get the waiver translated and bring it with him when he finally has his interview and explain to the consular officer that his wife mistakenly checked "no". Has anyone had a similar thing happen to them or know someone that has? It was an honest mistake. I also don't want them to think he's a bad person and not issue him a visa because of this incident. I'm so nervous now and have been crying all morning

Timeline

So where it asks the beneficiary to sign his name and swear all this is true...you forged his signature and affirmed it was true acting as him? 

 

I helped my husband fill it out but he reviewed everything and I definitely had him sign and submit it. 

 

You can have him bring the stuff and try to explain but a flippant answer of oh my wife did that to sounds like an excuse

No, he did review it but he was doing it from his cell phone. He didn't notice it until this morning when he was reading it again. It really was my fault. I will even write a statement for him to bring with him explaining it was my error and he hadn't caught it until it was already submitted. We're trying to be proactive by having him bring the information from the court and having him explain it so they can see he was forthcoming with the info and didn't try to hide it.

Morocco is a very tough Embassy, if they want to make this into a big issue they can... hopefully they do not. Usually if an error is made and you promptly correct it, its OK. Since you can not edit the 260 the only way to correct it is to tell them at the interview of the mistake. Do you have paperwork about the incident? Its probably a good idea to bring it. The Officer should be able to handle the correction if they are so inclined to do so.

I've already emailed NVC this afternoon and explained the mistake. My husband has the receipt showing the fine was paid and the proof that he was not convicted or serve any jail time. He is going to have this document translated tomorrow so if the NVC allows us to amend or do a new DS-260 we can upload this onto CEAC if necessary and also so he can have it on hand for his interview.

You will be fine, and they will not ask for anything! Just relax please and take your time! I’m Moroccan and I can tell as long as he obtained “Clear” on both Court and police records there is nothing to worry about!

I agree with CappuccinoMo, when I first filed out the I129 I made a similar mistake and corrected it after the fact and explained myself, I am sure that once he goes to his interview and explains the mistake that all will be fine, I don't think and I am sure they do too , that no one would be stupid enough and on purpose to lie to the government when they are trying to migrate. Relax, it was a mistake and they will know that, you can let NVC know by email, print that email and any response that they send and have him take it with him, this will show that as soon as the document was reviewed the error was caught and you tried to correct it immediately. All will be ok, good luck.

You email you need to call. Since you just submitted it hasn't been reviewed so call them so you can get it edited TODAY.

 

It will be okay even if they don't your husband can explain. Embassy is way more forgiven when people are upfront and admit an error that all it was not a try to hide or a lie. So relax okay.
