The real question is if the site or agency that you met is a member of IMBRA... 

Most of online dating site i believed is not an imbra... Anyway if you think is not imbra then you just submit your petition with the terms of use of the site and if you want to make sure that it's not an imbra, you can email them and request a letter from them stating they are not imbra

          worries before approval:

          1) submitted 1 statement/letter of intent both signed by the pet/ben

          2) petitioner's accidentally/stupidly committed DWI after i129f submission

2019 Jan 16 - NOA2 (140 days from Noa1 - No RFE)

2019 Feb 06 - case received by NVC (21 days from Noa2)

2019 Feb 08 - case number received

2019 Feb 19 - left NVC

2019 Feb 25 - case received by SG consulate

2019 Feb 28 - Packet 3 received

2019 Mar 04 - Packet 3 sent back to SG consulate

2019 Mar 07 - Packet 4 received (interview schedule)

2019 Mar 12 - Medical (additional vaccine on 19 Mar)

2019 Mar 27 - Interview (221g, medical results pending)

We have already applied, is there a way for us to send the USCIS this letter stating that they are not an IMBRA before we might get an RFE

Does the letter have to be in writing or can in be on an email?

Where can a list of IMBRA's member's be found?

For the USCIS, it is either a marriage broker or not a marriage broker.  Online or not has nothing to do with the definition of whether it is a broker or non broker

As i said.. You can just print the terms of use of the site, as for the letter, it can be a letter or an email of confirmation... 

 

Anyway, Im not sure if you can still send it and if it will find a way to your petition,.. Maybe others can answer.. 

All i can say is pray that you won't get rfe or just get rfe and respond with the above..

legit agencies will tell you upfront they are IMBRA sites and compliant with IMBRA laws. they will also provide the documents you will need when you request them for the application

normal dating sites do not fall under IMBRA purview

Almost no 'open to the public dating site needs to be IMBRA compliant.

 

The major issue is if their PRIMARY BUSINESS is to provide services to US citizens.  If they allow citizens from other countries then its not their PRIMARY business to cater to US citizens.

 

If you used a site that who's primary business was catering to US citizens and foreign women, then yes, IMBRA would apply.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
