To get married while there's pending K1 application?!?!

The I-129f referenced in that post is for a K-3 spousal visa--not a K-1 fiance(e) visa. That's why the I-130 is also mentioned. They had to file I-130 before they could file the I-129f for the K-3. Your circumstances are not the same. You did not file I-130. Your I-129f was for a fiancee, so the visa rules/uses are not the same.

Exactly! They filed I-130 because it is a requirement in order to file for K-3, the petitioner must submit the I-130 prior to submitting I-129F. Keep in mind that, for both types of visa, K-1 and K-3 you use the same form but the procedure and effects of each visa are completely different.

I am from the Phils and I have an opinion to share.

My niece got married to a USC too. I helped them processed all the papers with regards to their getting married here. Yes they got married, but they still filed for K1, becoz they didnt register the marriage to the civil registrar. I agree with Eric and Teresa, you may marry but have a ceremonial one, dont register it with the civil registrar, be sure you keep hold of the marriage certificate so u will b sure it wont be submitted.

There's nothing dangerous about it. In some legal systems, like mine, that are based on latin tradition, certain acts in order to have legal effects, need to be registered first, if not they simply do not exist, and that's the case of civil marriage.

It does not matter if you signed the marriage certificate, and we don't call it certificate we call it

'marriage act', you will ONLY obtain a certificate, after registering the marriage. As simple as that, if you don't bring the marriage act to the Civil Register Office and have them enter it into their records the marriage does not exist.

Let's not forget legal systems are different in every country! ;)

Please be more clear - are you planning to get married or are you planning to have a simple wedding ceremony? In many places a wedding ceremony does not necessarily create a marriage.

A marriage will cause you problems as a K1, a wedding ceremony may or may not depending on the law regarding marriage in the place where th ceremony takes place.

according to VJ, our NOA2 might be adjucted by July 15,2007.

we just want to have this simple wedding ceremony since both our families are in the Phils. For sure you know how happy it will be - to celebrate this love with close friends & family.

any opinion will be highly appreciated...

Good point - legal sustems are different in every country.

Let's also not forget that CBP and USCIS are not familiar with those different legal systems in every country - they are familiar only, and in general (not in detail), with the legal systems of the 50 states. So, if they spot something that could be a marriage, they will act as if there is a marriage until you convince them otherwise.

I agree with TimsDaisy - be very careful.

Good decision, fallowing the K1 route you should wait and get married in US, after that you can go back to your country and do a special ceremony for family and friends. :thumbs:

Of course it will. Once you marry---if the K1 visa process is not complete and the visa issued--and it's not in the US, you nullify the K-1 and you must start all over again with a K-3 application.

I wish people would stop asking this question. If you want to get married before the visa process is complete, please file for a K-3 or a CR-1.

True, however it SPECIFICALLY states she is filing for a K3. I dont think its unfair of us to expect the reader to check the visa type.

I mean this as nicely as possible but I think you are still misunderstanding the fundamental difference between the K1 and K3 and what the I-129F and I-130 mean in the K3 context. It is NOT the same as in the K1 process. There is some overlap, but it's a different system.

As for the ceremonial part - you can do it, my only advice was to be watchful of what you sign. As mentioned, of course legal systems vary in each country, so it's up to anyone here to figure out their own country's requirements and potential pitfalls.

Actually, very few NEW applicants will ask this kind of question. Many review the guides and options for K-1 and CR-1 and K-3 before applying and understand the differences.

When I went through POE with Sheryl the customs officer asked me 'So you two took care of the marriage in the Philipines?" I said no we will marry in the US. He asked Sheryl how we met and a few other things. Then he asked her "You two married in the Philippines then?" She said no we will get married in the US.

So if you get married and decide to enter on K-1 you also need to ask yourself if you are willing to lie to an immigration/customs officer to get in the country.

Why is it a lie? It's only a lie if you, in fact, married abroad. Don't marry. If you have a wedding party, that doesn't make you married.

If you actually marry, and enter on the K1, that's fraud and you're going to be in a world-of-hurt later.

Nothing in the questions you say were asked would need to be answered differently by a person who had a wedding party in another country. The answer to "did you marry there" is still "no." It isn't "yes" if you did not marry. And it certainly in no way needs to be "well, we had a wedding party but you see it wasn't a legal marriage because because because."

That would be a stupid thing to say because it may invent needless problems at the POE. If a K1 visa holder doesn't have the ability to navigate the language or remain calm enought to correctly answer the questions asked, then yes, having the wedding party first abroad would not be the thing to do.

So true, Yodrak. But we can keep trying to dispell the myths and reduce the unnecessary fear!

(Anecdotally, my best friend's brother is having his wedding to his Mexican bride in two weeks, and she'll be entering on her K1 a week or so after they honeymoon in Cancun. They'll then legally marry after she gets here. Not a hint of worry anywhere. They know the laws and they know what they are doing. I think sometimes this place, as helpful as it is, creates one new fear for every 4 it puts to rest.)

Lol its me Jenny from Phils. forum thanks for the infor in phils. I was already member here just a month ago.. i think this site is more helpful and fast reply.. Hows ur papers? Mine am getting lonely coz seen some of march filers here from Phils. too that already been approved there noa2 i was hoping mine too.. in gods time..

About ur post here i dont think its possible to get marry in Phils. while waiting for ur k1 visa i dont think its possible.. it will caused conflict in ur papers.. We was thinkin that too my fiance to get marry here while waiting for our k1 visa, but our lawyer advised us not to get marry legally , we can get marry but only ceremony, not registered something like that.. So we just decide not to get marry here.. just wait for our papers approval.. But still up to u girl.. Goodluck am hoping for ur speedy processing
