Under the new fee structure EAD will be automatically lumped in with AOS (correct?). But if I am filing AOS for my new K-1 wife right now, before any fee structure changes take effect, must I file for EAD if we do not plan on having my wife work outside the home and just do not desire, then, to go to trouble and expense of obtaining EAD? Would this tend to create any difficulties/suspicions?

Also, must I file an entirely seperate AOS for my 5yo stepson? Or is he somehow piggy-backed in on my wife's AOS (for the same single fee)?

I read that Homeland Security refrained from an expected announcement at a scheduled press conference 1st May of the fee increase implementation--perhaps in response to pressure from Congress, etc. Has anyone heard more about this?

Depends what you mean by work. When you say you don't plan on your wife working "outside the home" does that mean she's going to be employed to do work inside the home, or are you just talking housework etc? If she doesn't plan on getting a job, then no EAD is required. If she does plan on having a job with a salary, then an EAD is needed, regardless of the location of work.

Would this tend to create any difficulties/suspicions?

EAD is not a necessity and no suspicions will be created if you don't apply for it.

If your wife has no intentions of ever seeking employment then don't bother. However, if you think that she may want/need to work, then most would suggest applying for it, as you never know how long it can take to get her green card which also allows her to work.

We did not file for EAD for Marlene. She didn't work so it wasn't required. There can be reasons other than employment to apply for the EAD. We couldn't apply for a driver's license for her in Oklahoma unless she had the EAD or Permanent Residence card, so we had to wait.
