FILE USA TAX RETURNS: I just wanted everyone to know that I was able to file my USA tax return this year adding my wife on my return and applying for her ITIN number at the same time. Our PD date is January 2019 so hopefully this helps during the NVC phase. We filed married jointly without any problems. It took about 3 months to get the ITIN number, and now the tax return is processing and should be complete in 2 weeks. I just wanted to share my story for those that are considering filing taxes next year and want to add your spouse to prove more bonafide marriage evidence. So regardless of what you hear you can file a joint tax return even if your wife VISA is still pending or not approve.

After marriage and waiting on the EAD, Adjustment of status and all that .... can one file taxes with an ITIN and get all the tax deducations for spouse and child?  In my reading of the ITIN application form .. looks like a big fat no.  So I filed an extension ... but my refund is huge and I am getting impatient.

Yes. My wife does not have much income so that help. Filing jointly you suppose to include your wife income as well. But yes I received maybe 4,000 dollars more filing jointly

OK, good info.  I'll go get an ITIN and at least scoop up my return.  I should have been more aggressive in pursuing this info but I have been extremely busy with a job change/re-careering and trying to get a drivers license for wifey.

I was given a letter to expect it in 10-12 weeks at my mailing address. If it was outside of peak season (Jan to Apr), they said it would be roughly 7-9 weeks.

 

 

When I spoke with my accountant, he told me my state taxes and FBAR are automatically extended. I'm not sure if it is because I'm filing for ITIN but I was surprised I didn't need to fill out some forms. I asked him again whether I needed to fill some form for the extension and he replied that it was automatic so I plan to file after we get my ITIN.

If you live overseas you are automatically extended yes

This thread is a little old but I wanted to add my update.

 

We went to the Honolulu IRS office to apply for the ITIN. We had selected "e" Spouse of USA for the reason requesting the ITIN. The guy at the counter told we needed to attach an original, unsigned, tax return to apply using that option. Which wasn't an option since it's September. 

 

Anyways, he showed (or read rather) the instruction book to us. After a slight scolding and making me feel dumb, he showed us the back that listed the exceptions. There was an exception (1c) for an interest bearing account. Exception 1c only requires a letter from the bank saying we have an interest bearing account. 

 

When we went to the bank to get the letter they had no idea what we were talking about. I showed them the instruction book and the parts the IRS agent so kindly circled for us. About 15 minutes later we got the letter from the bank. They didn't know what to write so the just wrote XXXX and XXX have a checking and savings account #'s and #'s with us blah blah blah. The whole letter was 4-5 sentences. 

 

Went back to the IRS office with the letter. The agent took our application, the letter, and made a copy of my wife's passport. All and all it took about 15 minutes with the IRS once we had the "correct" documentation. The agent was actually pretty nice too. And the process was painless.  But we'll see if the application is approved in 7 weeks.

Update 10/12/19

 

just got a rejection letter from the IRS. In the letter it stated we were rejected and needed to provide prof of forigen stats. 

 

The IRS off made a copy of my wife's passport and sent it in. So apparently they didn't accept the copy their office sent in.

 

The letter also said I can resubmit by sending the original passport, national ID card,  or a state issued ID. So they didn't accept the passport copy their own office made. 

 

I I guess I'll just wait until I file my taxes and attach the W-7.
