K1 Visa with child involved (merged)

Timeline

I am a US citizen and my fiance has a 3 year old child. She resides with her mother, but were wondering when he gets approved and comes to the states if she will be able to come and go to visit before he gets his green card. Does anyone have any information? Thank you.

Is he the same fiance from Belize that you wanted to get a tourist visa for?

He didn't get a tourist visa so now you're going to try to get an immigrant visa for him?

He has a daughter and you're wondering if she can visit your fiance after he joins you in the US?

 

If I got your story straight, then yes, his daughter can visit him in the US if she can get a tourist visa and her mother allows her to travel to see her father.  Who will accompany the 3-year-old child to the US, though?

Ah.  Then your fiance needs to work on the US tourist visa application for his child.  He may also need documentary evidence that his child has permission from the mother to travel outside the country.  Check the relevant laws in Belize.  In my country, minors can only travel abroad with a companion who is not their legal guardian if parental consent is filed with the government.

 

Consider also that your fiance's child may not be granted a tourist visa.  In that case, your fiance will just have to wait until he has his AP (if he comes on K1 visa) until he can travel back to Belize to visit his child.  That will probably take about 4 to 6 months after filing for his AOS/EAD/AP in the US.

Thanks for clarifying.  Same suggestion as before: Apply for a US tourist visa for your fiance's daughter, and get any required documentary evidence of the mother's consent for the child to travel out of her country and visit her father in the US.

 

But, the probability that the child will be granted a visa is very low.  Your fiance will likely be the one doing the traveling if he wants to spend time with his daughter.

Hi! So basically I have to wait to be granted the visa first before applying or I can apply now while applying for the fiancee visa

 

If I get accepted, do you think I'll be able to travel back forth to see my daughter while waiting for the green card?
