OK. So that is good since he has a legal court settlement. And if he has the paper trail to show he is making payments then he is covered in that aspect. I suspect her claims of him not paying can be easily proven wrong.

 

The second issue is her case against him asking for more money. Legally she can ask for more. That doesn't mean she will get it. But she can ask. It will be up to the courts again to see if the settlement needs to be adjusted. She will likely need to state her case on why she needs more CS. 

 

Have your husband to start collecting every piece of evidence he can conjure up. Even text, emails, and such. Seek good lawyers. Hopefully, this can get resolved sooner rather than later but be overly prepared.

He’s not my husband yet he’s my fiancé and I’m 41 days post interview in additional administrative processing scared this is going to get me denied.

April 2018: London/Paris/York visit we got engaged on April 6th!!

April 19th 2018: packet sent

April 23rd 2018: USPS say packet signed for.

April 25th 2018: Electronic NOA1 received 

April 26th 2018: Cheque Cashed

April 30th 2018: hard copy NOA1 received

There is nothing besides certain crimes on his record (AWA-related) that would interfere with his ability to petition someone for a K-1.

Depends on state law,  could go longer if he must continue as long as they are still a student

No but it could call into question his affidavit of support I guess.

Mine is the later of 18 or graduated from high school with a max of 20 if they are still in high school but not yet graduated

Does anyone know if it’s going to get me denied if  a federal case has been raised? Like I said I’m in ap post interview.

It would not call into question his affidavit of support (assuming here that he makes enough to sponsor you).

I understand that you're worried but as far as your visa journey is concerned, this is a non-issue.
