Hi Folks,

I dont know if some of you recall my previous post regarding my dilema as to which visa my girlfriend I were going to choose. Im the lad from London who has the irregular "travel habbits" according to USCIS:-)

Well after much deliberation with the GF we have decided that the K-1 is the right visa for us. We have nearly finished our packet, and this weekend, i think i will be in a position to send it off.

My plan is to stay the remainder of my VWP (2 months and 1 1/2 weeks) then wait in London for the remainder. I have come to terms with the fact that if I try to enter while my K-1 is in processing, I will be likely denied entry.

My question is this! Has anyone been in the states (Non US citizen), filed for a K-1, returned home after VWP. then tried to re-enter say 2 weeks later?

It is so 50/50 with the immigration officials. My previous trip before I got interrogated for the 5th time, I walked through customs as if I was taking a stroll on a sunday morning! The guy let me through with no questions at all despite having my record right in front of him.

I firmly believe that you can tell what is going to happen based on what the official looks like. I know some of you will think i am being stupid, but I have predicted my interrogations, all five of them over the past two years without a failure.

If the guy looks like an a*Hole then chances are he is going to be, I wish i could have manouvered myself in the queue so I could target the official i would want to approach.

This last trip when I got interrogated, I was standing in the queue (line for those americans) and thought to myself, I am going to have to go to the left, because the center and right booths were occupied with people taking a long long time to clear. I said to myself, he looks like an A*Hole and I am going to get stopped. Low and hold I did.

Hi.

I applyed for the K1 whilst in USA, i stayed for 3 months and at which point i returnd to the USA, after 2 months in UK.

I had NO problem getting into USA and even got a song from the POA guy about the winds rolling down the plains of Oklahoma, lol.

I had all my information on me which stated i was returning to UK, he not ask to see any of it.

BUT im not saying do it or dont, this is just what i chose to do.

I will not be returning to USA until i have my visa now... good luck

Let me say... we and all cases are different.

K1

September 15 - 2005: NOA1

October: Waiting

November: Waiting

December: In Security checks

January 2006: Waiting

February: Waiting..Contacted Congress

March 4th: APPROVED

March 17th: NVC posted file to London

March 20th: London Receives file

March 29th: Receive package 3

April 13th: London Receives package

April 19th: Medical - June 13th: INTERVIEW......APPROVED!!!!

June 20th: ARRIVE IN USA

Time taken for whole process 9 Months

October: 13th: Sent off AOS Package

November 3rd: NOA1

November 14th: Snail mail ~ NOA1 ~ Case moved to the CSC for faster processing.

November 14th : CSC has petition for me and my daughter.

December 14th: Biometrics completed.

January 17th: APPROVED AOS!

January 22nd: Green card arrives in the mail:))

Time taken for AOS - 3.5 Months

Finished for 2 years.

I am unsure why you'd want to potentially give yourself more grief by leaving and then re-entering 2 weeks later, esp. seeing as you will have a K1 filed soon. I certainly wouldn't want to risk everything based on how an immigration officer 'looks'.

I traveled, I do not know your circumstances but as they have you in the system, if you are quizzed then you will need extra good evidence to support your return.

You will definitely need lots of proof that you plan to return after your "visit", such as mortgage/lease papers, recent pay stubs, etc. There is still no guarantee you will be allowed to enter the U.S., but I did it from Canada lots of times after the K-1 visa was being processed. The more proof you can provide that you intend to return, the better.

I read your other post about your travel habits. Being there for 3 months and returning for only two weeks and than trying to get back in again is really pushing your luck while doing the k1 visa process. Only your poe will be able to decide, but I wouldn't be pushing my luck like that. why not have your girlfriend come visit you? much safer that way. You definitely sound like ur madly in love! good luck
