I had an illegal entry ewi I was brought at 1 year old

Did you apply for AP with DACA when it was available? Those DACAers used AP to gain legal entry.

Isn’t there a waiver for working with false SSN? You can claim USC on tax form? You mean I-9?

As noted, there's no bar for illegally working with a false SSN as the spouse of a USC. There's also no issue if going through consular processing...past illegal work is not an inadmissibility for an immigrant visa.

If one ever claimed to be a USC for any benefit, then that is a permanent bar and no waiver is available.

Having only used the SSN of a USC (but not claimed to have been one or assumed their identity) is not an issue either.

Maria Yanez the answer is No. 100% sure.

The i 601waiver is a consular process, that is not what you doing. You will do adjustment of status. I130, i485, i485 with supplement A. Affidavid of support and medicals. Your us husban gets you a visa right away but you did not come here legally so typically you cant adjust status but in your case you have the 245i. You can adjust with ur husband and 245i. Make sure you are grandfather under the law. I did this process and am waiting on my greencard now.

Am from honduras and have daca too. No 601 waiver ok. All this is avaolable in the uscis.gov

She can’t do I-485A unless she had a petition on or before 4/30/01.

She can, if she is not the main beneficiary. If one of her parents have the 245i than she is grandfather. Only the main beneficiary had to be here before december 21 of 2000 and applied before april 30 of 2001. But i dont think this is her case. She has to do consular process

Unless she was a minor when any of her parent was petitioned before the deadline.

Looks like it will have to be I-601A.
