The 2nd time my husband came to the US from Canada we were already married... and the thing that's different is that he did NOT have any type of visa. He was allowed in...

He was still legally admitted, though. Note that: 1. You crossed at a legal border crossing; 2. You spoke to US customs/border officials; 3. He didn't intend to stay. He had a return bus ticket and the university registration was already paid for.

So he's not in a bad situation for that. He didn't sneak across the border dressed in fatigues and a painted face so no one could see him. He didn't stow away in the boot of your car like that couple on the East Coast. He figuratively walked up to the border, announced himself, and got through. Nothing illegal there on your end, so be positive in that! He isn't here illicitly and you're going off the information you had available. :luv:

If it helps to preserve your sanity, too, remember that USCIS can't expect everyone to be versed perfectly in US immigration law. You can easily point to all the inquiries that you made (indeed, many of us made!) and even the answers you got in Des Moines from the USCIS office. *hug* You're all good. :star:

Now I'm worried that this will look bad. Like, we had absolutely no intention of him staying to adjust status when we were at the POE and I'm guessing the officers knew that...otherwise would they have let us in?? Maybe, I don't know. Anyway, we heard it straight from an officer that he could stay and file AOS.

You're not nuts to worry about it; I can't tell you that because I'm worried about myself, too. But! (F) Try to keep your spirits up because you have taken all the routes that were available in getting yourself informed. Gwah, don't mean to sound like a broken record, but seriously, I think you'll be okay. It probably won't even come up and if it does, take the advice of others: answer honestly, to the point, and concisely. :)

5/23/03: Justin arrives to visit me in IA from SK.
6/7/03: We got married!
8/23/03: Filed I-130 from SK
8/25/03: Phoned border guards & asked if J could escort me back to IA, yes.
8/26/03: Arrive in IA
8/27/03: Went to USCIS local office to ask if J could stay in the US and file papers, yes
2004: I-130 approved!
6/05: Filed AOS/EAD
7/2/05: Rec'd receipt for I-485
8/05: Rec'd RFE for Biometrics
9/9/05: Rec'd RFE for medical
12/2/06: EAD APPROVED!
12/5/06: EAD card rec'd
1/15/06: AOS interview date for 4/11/06 at 11:00 a.m.
4/11/06: APPROVED!!!!!! NO MORE USCIS FOR 10 YEARS!!! WOOHOO!!! 2016...seems more like a page # than a year. Haha.
