Hello all,

 

I married my wife (lesbian couple) on February 2, 2019 and we are about to file all the paper work for her to get her green card.  A little background:  She was in the country as a B-1 worker (nanny who followed her US employer from another country).  Please let me know if I am missing anything.

Please kindly find enclosed concurrent filing of forms: I-130 (Petition for Alien Relative), I-485 (Application to Register Permanent Residence or Adjust Status), I-765 (Application for Employment Authorization), I-131 (Application for travel Document).

· Copy of Beneficiary’s Passport (ID page, entry stamp, B1 Visa)

· Copy of Beneficiary’s Virginia Identification

· Form I-864 Affidavit of Support

· Petitioners (US Citizen) Passport (Biographical Page)

· IRS tax return from 2016-2018

6. I-765 Application For Employment Authorization

· G1145 E-Notification of Application/Petition Acceptance

· Form I-165 Application For Employment Authorization

· Copy of Beneficiary’s passport (ID page, entry stamp, B1 visa, I-94)

7. I-131 Application

· G1145 E-Notification of Application/Petition Acceptance

October 10, 2019 - EAD approved

October 18, 2019 - Combo card in hand

February 24, 2019- Interview

We did K1 so I'm not sure on this one, but I think you should send a little more evidence then just a contract to purchase a home and photo's. Do you guys have a joint bank account, is she on your health / car insurance, joint bills etc? That's good evidence. But again, we did K1 so maybe in your case just the contract an some photo's are enough.

5. I-485 Application To Register Permanent Residence Or Adjust Status

· 2 Passport photos of Beneficiary (Inside a plastic bag and attached to form I-485)

· Copy of Birth Certificate

· Copy of Marriage Certificate

· Copy of US Citizen's Divorce Certificate

· Copy of Beneficiary’s Passport (ID page, entry stamp, B1 Visa)

· Copy of Beneficiary’s Virginia Identification

· Form I-864 Affidavit of Support

· Petitioners (US Citizen) Passport (Biographical Page)

· IRS tax return from 2016-2018 If you file tax returns, you need to provide supporting documents like W2, 1099 etc. If you file transcripts you don't need supporting documents (I would send it anyway just to be sure, but it's not mandatory)

6. I-765 Application For Employment Authorization

· G1145 E-Notification of Application/Petition Acceptance

· Form I-165 Application For Employment Authorization

· Copy of Beneficiary’s passport (ID page, entry stamp, B1 visa, I-94)

  2 passport style photo's of the applicant (beneficiary)

7. I-131 Application

· G1145 E-Notification of Application/Petition Acceptance

· Form I-131 Application for Travel Document

You can include joint bank accounts, wills, credit cards, evidence of currently living together including photocopies of DL as well.

· Copy of Marriage Certificate

· Copy of US Citizen's Divorce Certificate

· Petitioners (US Citizen) Passport (Biographical Page)  not needed for this form. Only required for a joint sponsor. 

include evidence of current income, pay stubs and/or employer letter

· IRS tax return from 2016-2018 - tax return transcripts are preferred. 

7. I-765 Application For Employment Authorization

· G1145 E-Notification of Application/Petition Acceptance

· Form I-165 Application For Employment Authorization

· Copy of Beneficiary’s passport (ID page, entry stamp, B1 visa, I-94)

· 2 Passport photos of Beneficiary

8. I-131 Application

I thought we can submit I-693 later because if I submit it now it might expire.  Can anyone clarify?

You can infact take the I-693 to your interview. You will get an RFE stating that you need to do so. 

Make sure the packet is sealed!!!
