my relative 's fiance was denied k1 visa at embassy. reason that she couldn't prove the relationship. with all the pictures of the ceremony with brides and grooms family, with all the phone calls , the visa officer denied the visa and send the petition to national visa center month ago. what is next, any one has this expereince

Pictures of a wedding ceremony prove that a marriage exists (already proved by the marriage certificate), they do not prove that the marriage is bonafide.

Nor do phone calls prove that a marriage is bonafide - they only show that someone may be willing to talk a lot if it will help get them into the USA.

What's next is consult with an immigration attorney to discuss the details of the case and get advice on what additional evidence the couple may have that would be useful given their circumstances.

the fiance petiton has been sent back to NVC per delhi embassy but no one knows, including NVC where the petition is. it has been more than a month

My fiances petition was revoked after his second interview on October 4,2006. It didnt reach NVC untill around december and then it was sent to CSC around January. It is still sitting collecting dust somewhere there becouse i still havent heard anything from them. I presume i will hear something soon saying the petition has expired and I am welcome to reapply. Just to let you know how slow they are.

You're positive it was that they couldn't prove the relationship? Perhaps I'm misunderstanding what I've bolded above but were pictures included of a wedding ceremony between them? Was there an assumption they were already married at all? It wouldn't be the first time that we've seen a "non-legal" ceremony cause problems at the Embassy.

You're positive it was that they couldn't prove the relationship? Perhaps I'm misunderstanding what I've bolded above but were pictures included of a wedding ceremony between them? Was there an assumption they were already married at all? It wouldn't be the first time that we've seen a "non-legal" ceremony cause problems at the Embassy.

we have heard from congressman's office that CSC don't look at returned k1 petitions. they advised to re-apply.
