Hi!

I am sending the I-130 for my husband tomorrow to the Vermont Service Center. I have read so much I think I'm going blind. Could anyone please tell me if my package seems complete????

background:

I met my husband online in 2004. I went to see him a few times in Nigeria since then. We had a baby in May 2006. My divorce was final in January 2007 (the ex dragged it out as long as possible) and we got married almost two weeks ago (yay!). I have two other children but I meet the requirements for the Affidavit of Support. I have been agonizing over sending the package for fear that something is missing.

The package includes:

*Cover letter detailing what is enclosed

*Filing fee

*I-130 Application

*Copy of my birth certificate (front and back) and all the pages of my passport (showing the visas from my entry and departure to Nigeria)

*Marriage Certificate (copy)

*Divorce Decree (copy) from my first marriage

*Birth Certificate (copy) and some pages of the US Passport (copy) for our son to show the bona fide marriage

*G-325A for me w/ passport style photo in plastic bag attached to paper behind my G-325A

*G-325A for him w/ passport style photo attached in same manner

*Marriage certificate (copy) from my first marriage showing my name change from birth to that marriage (the divorce decree and marriage certificate to my husband shows the other changes)

I assembled it in that order with numbered tabs separating the documents so they can find what they need easier based on the cover letter.

Do I need to include the affidavit of support? or is that for sometime later in the process (i mean after his interview at the embassy). I haven't looked ahead beyond his interview. My nerves are shot just trying to accomplish one task at a time.

Please offer suggestions or opinions!!

If it is simiar to K1, I think you will need proof of meeting; pictures, boarding passes, e-mails, etc

From what I understand (and I very well could be wrong), those things are not needed until I send in the I-129F

Sounds complete to me. I don't think you will need the pictures, emails, etc. We never sent them, after all, having a marriage certificate is darn good evidence of having met in person, especially with your baby's birth certificate, I don't see how that could happen if you've never met.

Sounds complete to me. I don't think you will need the pictures, emails, etc. We never sent them, after all, having a marriage certificate is darn good evidence of having met in person, especially with your baby's birth certificate, I don't see how that could happen if you've never met.

Yep, sounds complete to me too. Unlike K1, you don't have to show that you met. You need proof of a bona fide marriage, which you have (marriage cert., birth cert. of your baby!).

Even when you file the 129F for K3, you don't have to answer the question about having met in person in the past 2 years, just put N/A.

You did a great job arranging all. You are fine. If you decide to submit I-129F for K-3, you will need the proof that you had submitted I-130. Usually, people include a copy of the I-130 receipt notice. So go ahead and submit your I-130 along with all documents that you have arranged so nicely. You don't need to provide proof of meeting your husband in the last 2 years, since that is the requirement for I-129F fiance (not for married couple). Good Luck!

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Thank you all so much for all your kindness!! This is so helpful at such a stressful time. I did go to the post office today. I eliminated the marriage certificate from my first marriage. The divorce decree should be sufficient showing how my name changed the first time. I guess I don't want my husband to receive the copy of my first marriage certificate and dwell on things in the past. Everything else I listed was submitted.

Last night I looked over it all (for the 100th time) and found a mistake so I redid the forms. Today I looked over it one more time before going to the post office and I decided to redo it again! Before driving myself insane I decided to just get the courage and go to the post office (no need to stare at it over a long weekend). I reread it there again and finally the Postal worker said, "it's fine! bring it to me!" So i stuffed it in the envelope, swallowed hard and handed it to the lady. She said "it's mine now, you can't have it back, go home and stop worrying". I'm so #######!

We did the fiance' visa so I do not know about the requirements for the spousal visa. I do know that in Nigeris nothing comes as a surprise and all the usuals can be changed. Even though you are married, if he has to interview there, be prepared to show lots of proof besides the marriage certificate. One Nigerian couple just got approved after months of going back and forth and supplying more evidence. They finally required proof via a DNA test that the baby was his!! Totally ludicrous. What difference would it even make? I have 3 children and none are from my fiance'. That's such a difficult embassy. I'm sure you sent all that was required! Sounds like you studied the instructions repeatedly!! Good luck to both of you!

that's HORRIBLE! My husband's name is on the birth certificate and I have pictures of them together (I took the baby to nigeria for our wedding). When I went there I took with me the following:

1. Instant messages from 2004 to March 2007 (approx. 2000 pages, i only supplied 3 pages from each message .. some were 20 pages or more, i couldn't carry it all)

2. All of our emails (about 150 pages)

3. Copies of all my plane tickets, itineraries, luggage tags from the trips, receipts from airports during my layovers, church bulletins from when I went to mass with him in nigeria, copies of my stamped visas (every page of my passport).

4. Misc. bills and receipts from sending him things via USPS and FedEx, the receipt from our wedding rings etc.

5. All of our phone records from 2004 to present.

I plan to send him:

1. updated IMs, Emails, Phone bills and copies of the new passport pages with the visa from my last trip and the baby's passport pages with his nigerian visa.

2. a complete set of the I-130 and I-129F with NOA's attached which includes our marriage certificate and the baby's birth certificate.

3. Aff. of Support and evidence (I don't have tax records because I didn't file in 2006 but I will send a letter explaining why).

4. More pictures. He already has a few albums.

I can't imagine why they gave that other couple such a hard time! Thanks for the heads up. From all I have read it seems that when it comes to the consulate in Lagos more is better. I hope to overwhelm them with papers. I quizzed him for the interview too. He knows more about me than I do by this point.
