one more question, was your waiver a straightforward case or did you have government funding?

Lmao straight forward but I’m pretty sure it’s all up to the discretion of the IO so pray you get a really nice IO like I did she was really cool tbh

I would recommend applying for the adjustment of status after receiving the Favorable Recommendation (FR) from the DOS.

 

I say this because I originally applied for my I-485 back in October 2018, but I was denied before I even had the chance of having an interview. This resulted in me having to reapply again in August 2019 after receiving my FR. It was a horrible experience and waste of money. 

 

If you have the FR, you will have no issues applying for an adjustment of status I-485.

I'll wait, I have to get my marriage license and all and that will probably take another month so hopefully by then I'll have that fav. recommendation.

Thank you! I was freaking out because we thought we needed the waiver from uscis IN HAND before turning it in as a rfe. So i'm guessing we can just take a screenshot of the FR before the interview. THANK YOUU. Where did you have your interview?

I think it's case by case. my immigration lawyer told me our application processes through without them checking for waivers and stuff. USCIS only makes sure we have all the required paperwork and then it moves on to the next step. Only the IO checks our files in detail so if we get denied we would get denied at our interview.

 

My husband applied for i-485 based on marriage and although he had a j-1 visa we never got denied. On his visa it said he wasn't subject to the 2 year but when we filed for an advisory opinion it said he was subject so now we are filing the waiver. 

 

I would recommend you file the i-485 the same time or a little bit after you file for your NOS waiver. i-485 takes a long time to process and you'll be waiting forever to get an interview. NOS waiver is pretty quick in processing. Usually it's your embassy that will take a while before they send out your NOS, so call your embassy and bug them about it.

I mean there was nothing I could do but send the screen shot because the actually wanted the letter but the screen shot was all I had so I just had to send what ever I had and I guess it was good enough and I had my interview at the Oakland park field office in Florida

I don't know if it helps but mine was a fav recommendation on the 29...and still haven't received the letter from DOS either (3 weeks) or the receipt number of USCIS.

My case too, DOS sent favorable recommendation letter on August 7.  Still, I have not received any letter from DOS or USCIS.

 

FYI, DOS is sending recommendation to USCIS through electronically.

Have seen a few other posts in this forum earlier where they didn’t receive DoS letter/received it as late as after USCIS approval.

My home country govt funding was through an independent agency in the US, though. I’ll contact them and see if they were the ones that got this request...

It's not always about the US gov funding. They contact other types of sponsors too.
