So according to the lawyer the package has been delivered. But still 17 days and no credit card authorization. Lawyer said not to worry, but that’s a little hard to do! Lol

A little advice. This is whole process is going to be full of ebbs and flows. You're very early on and your worrying already. Typically everything has a path to take and a timeline that it follows. If you try to rush it by emails, phone calls, stomping your feet I can tell you nothing will upset you more when you feel that you are being ignored. You're not being ignored because their are millions just like you after a visa of sorts. So sit back, control what you can control, and leave the rest to follow its course. By the fact that you are on VJ is a good thing as you'll have a better understanding of the process. Best thing you can learn early on is to "trust the process".

 

And that process is you mail your application, your package gets delivered, your shipping company gets updated, you are notified by the shipping company or you have access to their package tracking system and you follow the "money". These first steps is a 2-6 week process so for you it's still early to be so concerned. :thumbs:

Thank you for your help! I do understand the process clearly as I made it to the interview stage a few years ago with my ex fiance. We received our noa2 and our petition was sent to the US Embassy before I withdrew it.

 

Im concerned this time for multiple reasons: 

-I’m 31 weeks pregnant. 

-I live abroad but am going to the US for 4 months this weekend without my fiancé in order to give birth 

-I’ve applied for a K1 visa for a different beneficiary within the last 2 years meaning I need to file an IMBRA waiver 

-I’ve just found out that the lawyer made a mistake on the IMBRA waiver saying that I’m due March 2019, even though multiple other documents sent to USCIS clarify that I’m due May (including my doctors verification) 

-I asked my lawyer multiple times to send me the waiver before she sent it to USCIS and she failed to do that 

-I’m worried we will receive an RFE 

-I teach abroad and will be unemployed until August due to giving birth in the US and so money is tight and I’m upset and annoyed that the lawyer made this mistake since we spent thousands of dollars. 

 

So I appreciate your advice about not being worried, but I’m sure you can see why I am! I’m not worried about the process itself, but concerned that we may have an RFE and I don’t want to have to repeat any paperwork because I am traveling and that will slow down our process. We’re trying to make a better life for when our son is born just as many other families on here are trying to do as well.

Is a signature required on delivery of NOA1? Case status was just updated saying that our document was returned and we need to submit an email request for a new one to be sent out? My fiance never received any notification or anything that attempted delivery was made etc. He just signed up for the informed delivery so hopefully that won't happen again. Will this delay our case at all as they couldn't deliver the NOA1?

-I live abroad but am going to the US for 4 months this weekend without my fiancé in order to give birth I don't know your motivation for going to the USA to have the baby but there are provisions that if the baby is born to a USC in another country they will have US citizenship. You just need to complete the CRBA from the US Embassy in your country.

-I’ve just found out that the lawyer made a mistake on the IMBRA waiver saying that I’m due March 2019, even though multiple other documents sent to USCIS clarify that I’m due May (including my doctors verification) There is nothing that holds you back from making a correction by passing the lawyer straight to USCIS.

-I asked my lawyer multiple times to send me the waiver before she sent it to USCIS and she failed to do that We are all capable of making mistakes but I would recommend that you get more involved with the process using the tools and ppl here on VJ. This is something that both the beneficiary and the petitioner can do. I hope you are getting the necessary support from your fiancé.

-I’m worried we will receive an RFE RFE's are not a case for denial, it's an OPPORTUNITY to correct information that is necessary to adjudicate your case. Most responses to an RFE tack on 2-3 weeks in the approval process.

Well, not knowing this history you can well appreciate my "words of wisdom". After reviewing your response I can well see that you have a large bucket of issues you are facing.

 

Note 1: If a United States citizen has previously filed two K visa petitions, and it has been less than two years since the filing of the latest of those visas, that citizen is not eligible to sponsor an additional visa. The petitioner may ask the government to waive this limitation, and the government may exercise its discretion in granting a waiver. However, the government cannot grant a waiver to the visa limitation if the petitioner has been convicted of a violent or domestic crime.

We recommend for those who can avail themselves of "informed delivery" they do so.

 

Why your mail was returned is a guess. Normally it is in with your standard mail deliver with no specific instructions for a signature or what not. Maybe the address they used on the mail could have been wrong. It's easy to enter a numeral wrong and not catch the mistake (on USCIS part not yours).

We just got our application back in the mail. Apparently they did not like the money order. We received no NOA or notification. I only suspected something was up as we hadn’t heard anything. When we called they could not even tell us why it was rejected. Although disappointed that we are now a month behind, happy that it was something so simple. Good luck!

A NOA is a notification of action and they issue a NOA1 when your file is complete and accurate. Yours supposedly was not correct hence the reason for the return and no NOA issued. Fix the error and return it back and you may not lose as much time as you quoted. This is a minor setback.
