I have a doubt while reviewing my RFE package. I have my Divorce certificate, legalized, translated and apotillada, with the signature of the director of the civil chamber ... But in the RFE letter they mention the signature of a judge or magistrate and in my country the judges delegate the signature to the secretary . And likewise it is in my sentence that they issued on the day they approved my divorce. I have the fear of sending all that and it does not work for them.

Have you considered asking that question in your subforum?

When you receive an RFE (Request For Evidence) the best way to handle the RFE is to read it carefully. Do ONLY what it says. DON"T add tons and tons of unnecessary documents. It's not needed and will NOT help your case. The adjudicator has already made up their mind about your case and if you do what they ask then they are going to approve your case. Of course if something in your past is hanging up the approval, hence the RFE then what you return will answer the question(s) that the Adjudicator has.

Thanks , have received the RFE letter. They need additional evidence of intent to marry. While filing We already sent intent to marry signed by me and him, what else can we send ? Seems like a simple request but is very nuanced . Please suggest what more we can share to support

Did you each send a letter of intent to marry, one from you and one from him? If not, that may be what they are after.

Below is the exact extract mentioned in the RFE

Intention to Marry Within 90 Days of Entry

Submit additional evidence that you and your fiancé(e) intend to marry within 90 days of your fiancé(e)’s entry as a K-1 nonimmigrant.

You may submit either the original documents or legible photocopies of the originals, including copies of the front and back of each document. If you choose to submit original documents, they will not be returned to you.

Finally got the RFE.

1. The petitioner forgot to check some boxes in the application.

2. More proofs that we have seen each other in the last two years. passport stamps and boarding passes, etc.

Thanks for your prayers and well wishes.

Submit new letters of intent by following this format.  One for the petitioner and one for the beneficiary.

Fiancé Letter of Intent

                                <petitioner’s name>
                                <petitioner’s address>
                                <petitioner’s phone number>
United States Department of Homeland Security
U.S. Citizenship and Immigration Services
<USCIS service center address>

                                <today’s date>

Dear Sir or Madam:

I, <beneficiary’s name>, do hereby state that I am legally able and willing to marry <petitioner’s name>, and intend to do so within 90 days of my arrival into the US using the K-1 visa.

Yours truly,

<beneficiary’s signature>

<beneficiary’s name>

Then do another letter but change the names from beneficiary to petitioner and petitioner to beneficiary.

That should take care of the RFE requirements.  The only other suggestion I have is to have both letters notarized.

We have sent both the letter in the above mentioned format in the past, only thing it was not notarised

I am wondering ... if this is common to ask for the same documents again else they need anything additional to the forms already submitted
