USCIS is not referring  to you if you have never been married. You both  are lucky as omitting prior marriages  could be grounds for  denial. You must list ALL prior marriages.

yea. i was glad when we got the letter and it was that cause we was worried for weeks what it could be

Both divorce court documents from the petitioner and nothing is needed from you. Don't know how you missed that requirement from the instructions where you sent one.

A level 2 has just informed us what our RFE contains. They want proof of knowing us, Letter of intent to marry the beneficiary And proof of divorce from the beneficiary. You are already working on this, in what comes the physical letter. Any advice for the RFE?

Who and what is a level 2? And how do we get in contact with a person of such level? Also I noticed you contacted your Congressmen, to what reason they play a part in this immigration process ?

Technically speaking, an RFE is a written request for more information and documentation that USCIS mails out if they believe that they don’t yet have enough evidence to approve or deny a given application.

There are many varying degrees of RFE's. Some as simple as not "ticking" off a question. Others forgot the fiancé(e) letter and then others who met on a website and now need to prove that it wasn't a marriage arrangement website.

Once you get your RFE, read over very carefully as you only have one chance to reply accurately without causing undue harm. Once you know what it is set out to correct and to include "everything" they are asking for. DON'T add anything that they have not asked for! Then reread the RFE to ensure you are compliant. Make copies of everything for your record and send back using their instructions which are contained within the RFE. If the RFE requires a signature, PLEASE don't forget this. Once received at USCIS your case will begin adjudication where the agent had left off. No one can tell you how long it will take so be patient.

Level two is what is commonly referred to as a Tier 2 agent. The T2 sees more information on your file then the agent you begin your conversation with. If you are out of normal status,  you have followed the steps to recertify your issues and you have further not received a response then some contact their congressmen for help with an issue for their immigration process. These are EXTREME steps to take and most are unnecessary for most who file.

We only call USCIS and ask to speak with a level 2, it is a USCIS agent with more access to information. Ask him to wait for Level 2 to call him back. (only petitioner) When we spoke with level 2 last Tuesday he told us that our case had been touched 4 times (7, 14, 21, 31 May) but they still had no decision. We found it strange and we wrote to the congressman and the same day they responded and the second one was updated to RFE. I recommend that you call and ask to speak with a level 2 and after this, take the decision to write or not to the congressman.

Many of our answers are predicated on the information you supply in your profile. When we look at the left column and can't determine your timeline OR your Embassy it's hard for us to give you a factual answer. Our answers will sometimes be tailored to a specific Embassy hence the reason for you to complete your profile. If you look at the profile of others here, they have a flag for their country, so it makes it easy for us to reply as we can quickly determine their Embassy. The country that should be used is the country where the interview will take place.

So, if you could help yourself out and complete your profile that sure would help us out when we want to reply to your question with factual information.

Go to the top right of this page select your name (it's on the upper right-hand corner)>my profile>[below your picture on the right column] edit my profile. Scroll to the bottom and fill in "Immigration Info". There now we can better serve you.

Once you finish that then return and you will see a flag in your profile. Select it and see what wonderful information will open up for you.

Thanks

The RFE letter has just begged my fiancé but does not mention anything about divorce ... What should I believe? because level 2 says it is needed.

Finally had an answer today as I’m waiting to board my last flight to my fiancé an RFE. Issued today. Is there anyway to communicate with USCIS to get a head start on processing this. Slightly deflated but I’m almost home with my love ❤️
