Why did you write to the congressman?  Was it about your case?

After waiting may the 10 for our rfe, we finally got it in the mail today. am so happy we finally got it.

however the letter says, you submitted your dissolution of marriage between you and *******, however, our records indicate that you had a prior marriage. you must establish that all prior marriages were legally terminated, as such, submit legible copies of all final divorce decrees that show proof of filing and signature from judges or magistrates; or the death certificates issues by the civil authorities that terminated the prior marriage.

can you all tell me what this mean? i read and understand that they want document that he was divorce from his first marriage. can you all explain it to me cause i want to ensure the right document is sent in.

"You must establish that all prior marriages were legally terminated, as such, submit legible copies of all final divorce decrees that show proof of filing and signature from judges or magistrates."

You must prove that YOU BOTH are legally eligible to marry and according to USCIS you did not do that with the information you provided with your application. Whomever has been married before, and that can be both of you, you must show that you are divorced. Send copies of all court documents pertaining to the divorce(s) along with the RFE and your cover letter explaining what you are submitting. Please, Please make copies of everything be submitting the RFE back to USCIS.

From the I-129f Instructions:

4. Termination of Previous Marriages

If either you or your beneficiary were married before, submit evidence that all previous marriages were legally terminated. Evidence of termination of previous marriages may include a divorce decree, annulment, or death certificate issued by a civil authority.

Yes sounds like maybe they did not list all prior marriages and USCIS wants information that they ALL were terminated legally.

@Greenbaum ok, i understand. my fiance which is the petition, is the one that was married twice and only sent in the recent divorce info, so they first state on the letter that he submit a dissolution of marriage between you and the person he recently got divorce from, which was her name their on the letter. i understand its still best we provide the 2 divorce info from the judge still just to make sure they have the necessary info. but me on the other hand i have which is the beneficiary as never been married before. should i get some form of document to state i never been married.

USCIS is not referring  to you if you have never been married. You both  are lucky as omitting prior marriages  could be grounds for  denial. You must list ALL prior marriages.

Both divorce court documents from the petitioner and nothing is needed from you. Don't know how you missed that requirement from the instructions where you sent one.
