Ah I have to write a letter, there is no form for it!!!

I am now back with my wife from the Philippines. It was alot of fun to be at the interview and see such chaos is such a little room. Now I want to get a job there. :P

Anyways, I have been looking all over for a good form letter to tell the NVC that my wife is here and we will be chasing after the CR-1 in the USA so we dont have to travel back to the Philippines to take that interview.

Would anybody have any ideas on how to write this.

Hi there!

I did the same thing and simply wrote a letter to NVC that was somewhat like this.

[your address]

National Visa center

Attn: change of address

32 Rochester Ave

Portsmouth, [sorry forgot the rest]

Case No. LLLNNNNNNNNNN

Petitioner: Hubbie, born on his birthday

Beneficiary: Me, born on my birthday

to whom it may concern:

This is to inform you that the beneficiary named above has changed his/her address to the following after receiveing a K3 visa:

[new address]

Despite the move to the USA and the reciept of the K3 visa, we will persue the CR1 visa process and will return to the Embassy in [country] for the interview.

I therefore ask you to update the information in your system and send all informatin regarding the CR1 visa for the beneficiary to the new address in the US.

We are aware of the fact that there is the possibility to adjust status in the US but we choose to follow the CR1 visa.

Thank you for your time and concern

Sincerely yours,

[signature]

something like that, not the exact way but that's what I remembered vaguely. Hope this helps. They accepted it, changed the address and I got everything concerning CR1 here in OK.

I could be wrong, but from your post, it sounds like you want to do AOS in the US and NOT go through with the CR and having to fly back to the Phillipines.

If this is the case, I am also in that position. I was just going to respond to the NVC with a letter that starts like the one provided by germanangel (all the case number/DOB stuff) but then just say something like, "We will be filling Adjustment of Status in the US and not returning to the foreign residence Embassy for a CR-1 interview".

To clarify........You will not be chasing after the CR-1 in the the US as the CR-1 is visa. You have already entered the US on the K-3 visa. What you will be doing is AOS in the US. CR-1 visa and AOS in the US are two seperate processes that both require an approved I-130. Keep that in mind when writing the letter so as not to confuse them :P

His ambiguous writing - he didn't say either status or visa - covered his a$$ this time. But he may not be so lucky with his letter to the NVC.

Rodjana didn't bother with such a letter - just used the DS-whatever Designation of Address and Agent of Choice form to advise the NVC of the situation.

If entry was on CR-1 visa then one would use the term CR-1 as status. Hence why I suggested he be careful in how he worded a letter so as not to confuse.

wow, I totally misunderstood that and thought he wanted to do CR1 after K3 and go back to have interview.

Duuuuhhhhh!!!!

If you do AOS you don't really have to do anything, right? Simply not repkying to NVC takes care of that. But of course you can always write them to let them know you won't persue CR1.

Sorry about my vagueness in this matter, I have been so busy and came down with a flu. In another words, my brains are fried :wacko:

Anyways, let me start from the begining. My wife was granted a K-3 visa in the US embassy. The I-130 was approved by USCIS just before I got there in the Philippines to attend the interview with her. She is here now and everything and the trip went smoothly. She wants to start working (it gets boring all alone in the house) and now we need to get her AOS. I was told in order to do this, I have to write a letter to the NVC stating that she is now in the United States and we will be staying here for the AOS. Everything else is like cake from there.

I was hoping someone in our situation has been through this and has good ideas on what should be in the letter.

you will get the DS 3032 from NVC. it asks you to assign an agent. It has an option on it that says I already have a visa and don't need to do this (not in these words of course)

Just send that back like that and you're set. No need to write a letter. You can also just call, I think but the form will come so doing that will be enough I think

I though we established that a K-3 AOSs to CR-6.

yeah that will do lol thanks for that. I knew what I was trying to say in reference to the OP's mentioning CR-1 but I couldnt find the actual number for the K-3
