*** K-3 May and June 2007 Filers ***

Thanks again everyone!!! However my happiness is partial, since only my I-130 was approved. They told me that my I-129F was still pending because it was sent 2 months appart from my I-130!!! Which makes me furious....like it was my fault that the CSC had "COMPUTER PROBLEMS" in sending out NOAs...

My priority was to get my husband here ASAP....and that was through the K3...I guess I can kiss it goodbye now (if they don't approve soon).

Do you think I can qualify for expedite process? At the USCIS website it tells you can request if there was a USCIS error. I don't know what to do anymore...I am tired of waiting.

YGandMAT.. don't believe everything they tell you. Hang on to some hope. Who told you that? Was it one of those idiots that answer the phones or did you get a real USCIS worker? If I were you, I'd wait a few days and see if the I-129F catches up, if not, do whatever it takes. Try to get it expedited, what's it going to hurt to try? Call your congressman.. do whatever you have to (within legal limits of course). At least you won't feel like a puppet waiting for the puppet master to decide your fate anymore. I called my US Rep two weeks ago. When I called for the 3rd time to find out if they are working on my case they were annoyed that I was interrupting them while they watched the Price is Right (yes it was blaring in the background) they informed me that the "guy" who handles that was out of the office.. I got that line every time. I finally just called my Senator's office and they seem to be more serious. Hopefully I'll hear something in the next few days. Of course I came up with a possible reason for them to intervene not just that I'm tired of waiting. Everyday is a struggle waiting helplessly. If expediting was a possible option for me, I'd try it.

Thanks DivineMercy, Yes I was told this by one of the idiots who answer the phones. Wow they can really put you down. I will try to go for it, if it works it works, if it doesn't, OH WELL, what else can I lose? More Time? I really doubt it. Good luck with your case, I really hope you get approved soon.

I only got touched once before getting my NOA2 on my I-130, and that was because I did an online address change. I called USCIS asking why they haven't approved the I-129f yet, and the lady told me that they're processed separately...strange, because the trend is that they're attaching the two forms together, from what I understand. She said it could take another month to process the I-129f, which sounds suspicious because I sent both forms in at the same time....

John and Celia, this is strange, both of your applications should have been approved. I was told the same thing...that my I-129F would take from 30 to 60 days to approve. However, I was also told by a USCIS agent that since my I-130 was approved first and even if my I-129F was approved I could no longer use the I-129F to seek a K3. Is this true?

I am very discouraged right now.

It is strange, I know, but I think I know what happened....if what the lady said was correct, then maybe two separate people reviewed the applications, and only one of them updated the website. There have been a few remarks lately that people have received their NOA2 hard copies but the website says "still pending". I'm hoping that when I get my hard copy of the I-130 NOA2 that the I-129f NOA2 will be in the envelope too....we can always hope! Good luck on your cases too! :thumbs:

If you won’t receive your NOA2 I-129 shortly report this to CIS Ombudsman. Your petitions got separated and you send them together. http://www.dhs.gov/ximgtn/programs/editorial_0497.shtm

It is NOT true, as long as your I-130 is not approved by NVC and later on arrives at embassy the I-129(K3) is still valid.

I got both cases approved in the same day, i received the NOA2s in the mail... and... in NOA2 for I-129f it say that my case was approved and sent to NVC. In NOA2 for I-130 it say that my case was approved and if i want USCIS to send my case to NVC i have to send them I-824 form. I called to USCIS to ask about that... and (i found the stupid CS repr on Earth... she told me that after i arrive in USA i have to married with my wife... so...) ... anyway... she told me that it takes up to 6 month to "approve" my petition for I-130 to be sent to NVC (i-824)...

My conclusion is ... Even both cases are approved in the same day the only visa that we'll have is K3...so... we just wait for yellow envelope to come from Embassy.

Anyone knows something else!?? Anyone who got both cases approved in the same day could applied for IR1/CR1?!

Unfortunately I’m still waiting for both NOAs but what I read:

*To approve I- 824 (Application for Action on an Approved Application or Petition) takes 6 months indeed, and then from 3-6 to process I-130 in NVC.

*Unless you didn’t mark clearly (on envelope when sending I -130) that you want consular rout, to avoid waiting your option is continuing K3.

USCIS keeps ready I-130 for begin AOS procedures when your wife finally gets to US.

In my time on this forum, I don't remember seeing anyone actually say that marking the envelope/cover letter etc with "consular processing" has worked.

I do know of at least one person on this forum (can't remember their forum name though, but I believe they were a March filer) who put as clearly as humanly possibly that they wanted consular processing on the I130, only to have the USCIS completely ignore this and send on only the K3.

So marking the I130 with consular processing is not 100% effective at getting both forms sent on to the NVC :(

Not necessarily. We don't have lots of data points on this, but VJer neenuh had her I129F returned to her because her I130 was already approved. It is possible that USCIS will not adjudicate without a pending underlying I130. Her I130 was only approved by USCIS, and she has recieved the fee bill and stuff, but far from "approved by NVC."

The Vjer you are thinking of is LvivLovers. They wrote it on the petition several times and on the cover letter. It was easily ignored by USCIS. Nobody has reported that "clearly indicating" has worked for them here on VJ.

I am so sorry to hear about your situation!! I have a question and a suggestion for you.

My question: where did you call to find out you were under "Additional scrutiny"? Was it CSC? NVC?

My suggestion: I recently became US Citizen. In that process, there is a very similar stage to this, where "FBI Name Checks" were delaying everyone's process. I learned everyone was suing USCIS and submitting "Writ of Mandamus" to force FBI to action. I am no expert on this field and all I am writing right now may be completely twisted, but I do know you can learn more of what others did on this forum: http://boards.immigrationportal.com/showthread.php?t=194681

Most likely the citizenship process is radically different from the K3, I-130, etc., but the bottom line is the same: FBI security check hanging a crucial process in a person's life. Hopefully the information on that other forum will trigger some useful ideas for you.
