Thank you pkewl, this experience is one I really need to put behind me. Every part of this has been extremely difficult. When I married my husband in March 2007 and someone told me in November 2007 you would be still waiting for your approvals. I would have thought that person was crazy and seriously needed help! But, reality is true and there is not a damn thing we can do... I do have a little news to share from the Congressman Office. I'm not getting my hopes to high but, I was told today by end of next week USCIS should be completed with our RFE and the decision made. So, I HOPE TO GOD THESE WORDS ARE TRUE TO CLOSE THIS NIGHTMARE!! Time will tell.. But, congratulations on your approval. :thumbs: We are waiting to hear these words...

I am so sorry to hear about your situation!! I have a question and a suggestion for you.

My question: where did you call to find out you were under "Additional scrutiny"? Was it CSC? NVC?

My suggestion: I recently became US Citizen. In that process, there is a very similar stage to this, where "FBI Name Checks" were delaying everyone's process. I learned everyone was suing USCIS and submitting "Writ of Mandamus" to force FBI to action. I am no expert on this field and all I am writing right now may be completely twisted, but I do know you can learn more of what others did on this forum: http://boards.immigrationportal.com/showthread.php?t=194681

Most likely the citizenship process is radically different from the K3, I-130, etc., but the bottom line is the same: FBI security check hanging a crucial process in a person's life. Hopefully the information on that other forum will trigger some useful ideas for you.

You can try the expedite, but I would think they would reject the notion since you are well within the processing times for both I129F and I130. You sent the I129F in July and the I130 in May? right

Thanks again everyone!!! However my happiness is partial, since only my I-130 was approved. They told me that my I-129F was still pending because it was sent 2 months appart from my I-130!!! Which makes me furious....like it was my fault that the CSC had "COMPUTER PROBLEMS" in sending out NOAs...

My priority was to get my husband here ASAP....and that was through the K3...I guess I can kiss it goodbye now (if they don't approve soon).

Do you think I can qualify for expedite process? At the USCIS website it tells you can request if there was a USCIS error. I don't know what to do anymore...I am tired of waiting.

Melissa, I hope your approvals are around the corner. They are processing I129Fs well after your date, I wonder what the hold up is? I thought by sending them together, you were going to get approved ahead of a bunch of us who sent the I130 in April and waited for the NOA1

Congrats on all the approvals...mine should come through real quick now (mailed out 5/31)....G&A, when will we have an updated chart? I'd like to see where I stand in comparison with the other applicants, since I sent in both forms at the same time. It'd be interesting to see if having sent in the I-130 earlier than the I-129f makes a significant difference. Thanks!

I sent in both forms at the same time at the end of April and I don't see any significant differences, I'm still waiting for my NOA 2's. I think that no matter what you do nothing can speed up your process, we are all in the hands of the slow service centers especially California Service Center.....

Divine, are they still going to adjudicate the I129F or will they eventually notify you that they won't because you no longer have a pending underlying I130 which is required to get an I129F approved? This happened to Neenuh. :wacko:

YGandMAT.. don't believe everything they tell you. Hang on to some hope. Who told you that? Was it one of those idiots that answer the phones or did you get a real USCIS worker? If I were you, I'd wait a few days and see if the I-129F catches up, if not, do whatever it takes. Try to get it expedited, what's it going to hurt to try? Call your congressman.. do whatever you have to (within legal limits of course). At least you won't feel like a puppet waiting for the puppet master to decide your fate anymore. I called my US Rep two weeks ago. When I called for the 3rd time to find out if they are working on my case they were annoyed that I was interrupting them while they watched the Price is Right (yes it was blaring in the background) they informed me that the "guy" who handles that was out of the office.. I got that line every time. I finally just called my Senator's office and they seem to be more serious. Hopefully I'll hear something in the next few days. Of course I came up with a possible reason for them to intervene not just that I'm tired of waiting. Everyday is a struggle waiting helplessly. If expediting was a possible option for me, I'd try it.

just wanted to add that i spoke to a very nice person at uscis last friday. i decided to do a routine check, given that the website is getting reports as unreliable. i was checking for rfe that was not sent or something exciting, like - an approval?

the nice person said that my case is still pending and that so far there are no questions, and i simply have to wait for the further notice. ok. nothing new. which is good and bad.

however, my case was NOT touched after this conversation. website status of my case has not changed.

i don't think that touching really means much.

I called yesterday as well and nothing changed on the website for me either. When I looked this morning, the date changed on I-130 (which is the case I called about) changed to today's date, so look again tomorrow and see if it changes.

I have a theory...

I've read about some lucky people who had a few touches before their NOA2 approval.

I've also read about some other people who had zero touches, no email, but they also got their NOA2 approval by regular mail.

So, here is my theory: if you call for your routine check and you get a touch, then it means most likely you will get to see a few touches before final approval. On the other hand if you call them and you don't get a touch, then it means you have to be checking your mailbox more often, cause you could get your approval without any warning.

Just a theory...

Timeline

I only got touched once before getting my NOA2 on my I-130, and that was because I did an online address change. I called USCIS asking why they haven't approved the I-129f yet, and the lady told me that they're processed separately...strange, because the trend is that they're attaching the two forms together, from what I understand. She said it could take another month to process the I-129f, which sounds suspicious because I sent both forms in at the same time....

John and Celia, this is strange, both of your applications should have been approved. I was told the same thing...that my I-129F would take from 30 to 60 days to approve. However, I was also told by a USCIS agent that since my I-130 was approved first and even if my I-129F was approved I could no longer use the I-129F to seek a K3. Is this true?

I am very discouraged right now.

11.21.07 - APPROVED!!!! APPROVED. GOT AN E-MAIL ON THANKSGIVING!

03.03.08- INTERVIEW IN CIUDAD JUAREZ. VISA GRANTED ON 03.03.2008

3.10.08 - Case Received at Chicago Lockbox, check cashed 3.14.08

3.17.08 - Received both NOA's in the mail

3.21.08 - Received Biometrics appointment letter in the mail, biometrics Appt. 4.02.08

5.05.08 - EAD Card Production ordered GOT EMAIL (we received the same email on 5.09.08)

5.13.08 - Approval Email for EAD (so the card was ordered first, and then we were approved...hum)

5.15.08 - EAD Card Received in mail.

8.08.08 - WE GOT OUR INTERVIEW APPOINTMENT YAY...9/12/08 - INTERVIEW APPROVED

9.24.08 - Received Green Card in the mail YEAH!

***I-751***

6.15.10 - Mailed I-751 Docs to CSC, check cashed 6.24.10

6.26.10 - Received NOA in mail dated 6.21.10

6.29.10 - Received Biometrics appointment for 7.15.10
