*** K-3 May and June 2007 Filers ***

Baaj,

The problem is that your I130 is going to be held by USCIS for later AOS. It will not be sent to the NVC, this is the new process when they adjudicate K3s and manage to pair the petitions. To get your I130 moving again, you need to submit a I824 and pay a $200 fee. Then wait for that to be processed (which again can take the USCIS 2+ months), then you have to wait 4-6 months for NVC to complete the case and forward it to China, and then you will have to wait for the interview. It seems to me, you would be much better off waiting the 3-4 months for the interview for the K3.

You should be able to view a similar chart to the K3 for the CR1 using the immigrations timeline link at the top of any page.

So, based on everyone's input, it sounds like I am pretty far along in the K-3 process and probably should continue that way. According to the stats on this site, the visa processing center in China is very slow for K-3's - 113 days from consulate receiving info to interview, so I'm not in the clear yet.

So it is because of this 4+ months that I was wondering about the speed of the I-130 processing. Is there a chart here for processing times of the I-130 that is similar to the K-3?

For the first time since submitting my I129F, my VJ timeline has my I130 projected adjudication date later than my I129F date. There was a one month delay in my sending the I129F because I was waiting for the check to cash and the receipt. VJ always said that I130 should be adjudicated before the I129F, and for a few days in July, it had the same date. But, I130 CSC approvals must have slowed significantly for it to have slipped passed the I129F projection. At the begining of the month, my I130 projected date was 9/22 (come and gone), and has been slipping ever since. I129F has slipped from October 10 to October 27 (so slowing down, just not as much as I130s).

Honestly, when we abandoned the K1 process about a year ago and decided to get married and do K3, if anyone had said that I would be waiting for my wife 162 days after filing a petition, I would have thought that would only happen if we went CR1. 2-3 months for I130, 3 months at NVC with James' shortcuts, and a week or two to get the interview. For K3, I was thinking 2-3 months for the I129F, 2 weeks through NVC, and a week or 2 to the interview. That is what VJers were experiencing then, only a week or 2 difference from the K1, so no big deal.

Unfortunately, my crystal ball is only clear when I look into the past.

2) What other pertinent doc's did u submit in place of a copy of the 130 NOA1

lastly, how do you check to findout when your file was last "touched" ?

I believe most people now are filing both together, so there is no delay. Unfortunately, this will not count for you as you have already filed one.

When my husband filed my I129F, he managed to get the reference number off the back of the cashed money order (also applicable to cheques). He sent off the I129F with a photocopy of both sides of it. Just ask the bank/money order company for a copy of the item and it should be there.

I'm not sure what length of delay USCIS have with cashing cheques at the moment (due to the backlog), so there still may be a delay, maybe someone else has a different idea :)
