So do I130s and I129s get paired off arbitrarily? because it seems like some people have them both approved at the same time and yet others have one approved but not the other for a long time

Its not arbitrary, they really do try to pair the petition. Neenuh's I129F was filed very late, and may not even be openned and receipted due to the receipting frontlog. They processed her I130 on the CR1 timeline, which seems to get I130s through a little faster than K3s.

I am sorry - I am fairly new to all of this and just trying to undestand how they process things. I have filed the I130 - and am not pursuing the K3 with the I129f... But I do check this thread to see if anyones I130's are approved and their timelines....

Urge - is is just speculation that I130's get approved faster when not filed in conjunction with a K3 based on VJ timelines - which could explain to me why some April filers (from CSC) are just getting approved now on this thread and there have already been 2 mid-May approvals in the CR1/IR1 threads...?!?

I don't think it's like that at all. We probably just don't have any May filers that have been approved on this forum... that doesn't mean that out of the thousands of filings there haven't been a lot of May people. Remember that in this forum there is only a very small sample of the amount of filers in CSC

Hi,

While we here on VJ represent a small portion of all the pending petitions at a given time, so whatever analysis we do, we must keep that in mind. As far as processing timelines, we represent a small random sample of processing timelines. Almost no analysis looks at an entire population, but attempts to extrapolate from small random samples. From what we are seeing here, yes, I130s for CR1/IR1 get approved slightly faster than those of K3s. While our opinions might not be representative as our habits and skills and access have led us to this forum and that might make us different from the population in general. There is no reason to assume that our processing timelines are not a random sample, albeit a small one.

Hello all VJers!

Thanks for your advice. I looked at the Guides but since both the I-130 and I-129F were approved at the same time, there isn't anything that addresses this. I guess I will just wait until I get the Approval letters in the mail and see what they say.

Guys (and gals) hang in there! I know it is beyond frustrating. I still can't believe mine has been approved. I am waiting to wake up from this wonderful dream :dance:

I did write a letter to my senator but I don't know if that really did anything. The senator's response time was almost as bad as USCIS!

I sent in my I130 in may and was approved in July so it has happened.

Thanks so much for keeping it up to date for us :thumbs: I just hope that the estimate for ours is close because it would mean that our approval will be just a little over 2 weeks away. Just to get the CSC out of the way would be a huge weight of our shoulders. It's been such a hard, stumbling block and it seems to be never-ending. I don't want to have to get to the point where a senator becomes involved because that will mean it's gone on far too long :(

I'm not sure if anyone has asked this before, but is there any way for you to keep the estimate column and add a fresh column for the actual approval date? It would make for interesting viewing when comparing the 2, especially when we start to see many more green highlights :)

Unfortunately I think we should add three weeks or a month to the projected dates on the graph.. we still have some march and april filers that haven't been approved yet. And we're definitely not at may yet. It's starting to look like a five month wait rather than four... i think you and i are going to get our noa2s sometime in november rather than october. i hope i'm wrong...

One thing I had noticed when looking through the timelines is that the average for CSC has really been skewed by the "out of the ordinary" I129Fs being approved (where the I130 was sent in many many months before the I129F, yet they get approved together). That might explain why we are seeing so many people actually wanting to get their petition sent to the CSC :wacko: It gives a false hope :(

Mid-November is still an open possibility in my mind, I haven't ruled it out and won't be mentally-unprepared if approval is still a month and a half away. Any later than that would be soul-destroying though. Having to psych myself up for each step of the process takes so much. I'm still praying for my completed visa by February and, sadly, the longer USCIS takes, even that estimate is beginning to look shady :(

I started this process in April hoping we would be together by Christmas, then pushed my estimated date back to February when I did some research on here. Christmas is what I class as my "uneducated guess" because we started the process before I came across this site and I honestly thought that the USCIS "6 months" was the beginning to the end. I'm lucky because the consulate processing time for the UK is about 2 months from receipt, add to that a month for the NVC (including the time the USCIS take to mail it, and the NVC to mail it to the consulate) and we still might make it. It brings the reality home and makes me realise (even with USCIS blunders) how fortunate Josh and I are. Our consulate wait is a lot less than many other countries.

The thing which gives me a small bit of hope is that USCIS have stopped giving a separate K3 processing time (I really hope it is positive, rather than USCIS trying to hide it's bad turnaround's). So maybe they are working to the I130 dates instead. After all, if it is a separate processing time, then they've failed to mention it for the last 3 months.

yup, we sent our I-130 around the last week of april, and our K3 over a month ago

we couldn't mail our K3 without our receipt number (result of USCIS' inefficiency)

i just hope they consider our K3 petition - i am kind of worried about it since it was sent late

and then the backlog, yay!

i do hate the waiting, but what choice do i have?

it wouldn't be so bad if the husband was waiting with me

we're all on the same boat, so hang in there - it will all get better soon :)

I think the waiting is making all of us crazy...just try and stay positive...we all know the system sucks the big one but there is nothing we can do about it right now. I posted this initially in the March thread waiting for transfer to NVC. I'm posting to this thread to hopefully allow you to set your expectations on the step following approval. Sadly, once again, it is best to lower our expectations.

I spoke with USCIS CSC just a minute ago. Like others I'm very disappointed at yet ANOTHER significant delay in my paperwork. I wanted to understand why it is taking so long to ship the I-129F to the NVC. This is what the kind Chinese lady told me.

For an I-130 application, they can simply send the application "as is" to the NVC. Therefore, shipping the I-130 is pretty quick.

For an I-129F, K-3, application, the paperwork has to be physically manipulated by hand by pulling certain documents and putting them into new file pouches. Then the I-130 application has to be filed and stored to be held for the AOS. This is what they are referring as the staging area.

I asked how long this should take. She replied saying they don't have a good estimate, since they are new to this process. (As we all know by now.)

So it looks like we are being held up by the huge backlog or surge in applications. We just jumped in at the wrong time for "quick" processing. She said it's been taking about a month.

It now doesn't seem to me that we are just sitting around waiting to be shipped. Instead we are again finding ourselves waiting on low resources to deal with the surge they have experienced. Funny, you would think they could keep up with the pace of adjudication. But that would be too logical of an assumption.

Hope this helps. For me, IF THEY WOULD SIMPLY EXPLAIN THE SITUATION AND TRUTH OF THE MATTER, I wouldn't have been as frustrated. Although, I have thankfully handled this much better than I anticipated.

As my mom says, "Don't pray for patience. The way you learn patience is by waiting." I have not been praying for patience, but I still received a nice, long wait. :clock:

Sorry if this is common knowledge. I don't remember hearing these specific handling details.
